UPON the Applicant’s Application filed herein on the 25th day of June, 2024 coming on for hearing on the 31st day of July, 2024:

UPON READING the Notice of Application and Affidavit in Support of the Applicant filed herein on the 25th day of June, 2024 and the Affidavit in Response of the Respondent filed on the 26th day of July, 2024;

AND UPON READING the Notice of Application for Recusal of Justice H. Patrick Wells and the Affidavit in Support of the Respondent filed on the 19th day of July, 2024;

AND UPON HEARING Ms. Anika N. Jackson, SC, Attorney-at-Law and Solicitor General of Barbados in association with Ms. Marsha L. Lougheed, Attorney-at-Law and Deputy Solicitor General, Mr. Rico Yearwood, Attorney-at-Law and Acting State Counsel and Mr. Justin Nurse, Attorney-at-Law and Acting State Counsel for the Applicant;

AND UPON HEARING Mr. Steve Ian Straughn, Attorney-at-Law and Respondent, on his own behalf.

IT IS HEREBY ORDERED that:

  1. Pursuant to subsection 36 ( l) (a) of the Supreme Court of Judicature Act, Cap. l17A, the Respondent is restrained from instituting any legal proceedings against the Applicant or any other public officer or functionary in the service of the State of Barbados, in any court, without leave of the High Court.
  • Pursuant to subsection 36 ( 1) (b) of the Supreme Court of Judicature Act, Cap. 117A, the Respondent is restrained from, in any way, continuing any legal proceedings instituted by him before the making of this order in any court, against the Applicant or any other public officer of functionary in the service of the State of Barbados, without first obtaining leave of the High Court.
  • Any application for leave made pursuant to paragraphs 1 and 2 of this order shall be made in writing and shall be considered by the Court on paper only, without an oral hearing.
  • Pursuant to subsection 36 (2) of the Supreme Court of Judicature Act, Cap. 117A, a copy of this order shall be published in the Official Gazette, at the earliest practicable time.
  • Cost is awarded to the Applicant, to be assessed.
  • This Court shall remain seized, until the matter of cost is determined.
