Re: Town and Country Planning Act 1968 (as preserved by section 108(1) of the Planning and Development Act 2019-5).
Modification of Condition numbered 3 of Planning Permission No. 3270/10/05A dated June 2, 2006 (the “June 2 Permission”) and Condition numbered 10 of the Planning Permission 2467/08/05A dated June 7, 2006 (the “June 7 Permission”) (together, the “Public Access Conditions”).
Having considered the application of CBL Developments SRL and being satisfied that the Public Access Conditions of the Planning Permissions granted on June 2, 2006 and June 7, 2006 respectively (together, the “June 2006 Permissions”) under the Town and Country Planning Act 1968 (“the former Act”) were imposed upon mistaken factual and legal assumptions and serve no continuing planning purpose, and for those reasons it appearing to the Director of Planning and Development to be expedient that the 2006 Permissions be modified in the manner hereinafter provided:
The Director of Planning and Development, acting under and pursuant to section 24(1)(a) of the Town and Country Planning Act 1968 as preserved by section 108(1) of the Planning and Development Act 2019- 5, Hereby Orders that the 2006 Permissions be and are hereby modified as follows:
1. 2. Condition 3 of the June 2 Permission, to wit, “The existing public access to the beach on Lot B shall be maintained for public use at all times”, is deleted in its entirety.
Condition 10 of the June 7 Permission, to wit, “The existing public access to the beach from Highway 1 shall be maintained in a manner that allows the public to pass and re-pass at all times”, is deleted in its entirety.
All other conditions remain unchanged and in full force.
No compensation is payable in respect of this modification.
