ICC CRICKET WORLD CUP

(USE OF AIRSPACE) REGULATIONS, 2024

The Minister, in exercise of the powers conferred on him by section 48 of the ICC Cricket World Cup West Indies Act, 2024, makes the following Regulations:

  1. These Regulations may be cited as the ICC Cricket World Cup (Use of Airspace) Regulations, 2024.

2.(1)         No person shall during a match period fly

  • a kite; or
    • an aircraft, a drone or any other aerial object not authorised by the Minister

over a CWC 2024 venue.

  • A person who contravenes paragraph (1) is guilty of an offence and is liable on summary conviction to a fixed penalty of $500.
  • Where a person contravenes paragraph (2), a member of the Barbados Police Service shall
    • ask the person to give his full name and address;
    • serve personally upon the person a fixed penalty notice in the relevant form set out in the Schedule; and
    • send a duplicate of the notice to the clerk of District ‘A’ magistrate’s court.
  • The fixed penalty notice shall be signed by the member of the Barbados Police Service and shall state the following:
    • the date, time and place of service of the notice;
    • the provision of this regulation which creates the alleged offence and such particulars of the offence as are required under this regulation;
    • the time within which the fixed penalty may be paid in accordance with paragraph (7); and
    • the clerk of District ‘A’ magistrate’s court to whom the fixed penalty may be paid and the address of District ‘A’ magistrate’s court where the fixed penalty may be paid or remitted.
  • A person who refuses to answer or who gives a false answer in respect of a question mentioned in paragraph (3)(a) is guilty of an offence and is liable on summary conviction to a fine of $500 or to imprisonment for 6 months or to both.
  • A person upon whom a fixed penalty notice is served may complete the notice in the prescribed manner and pay the fixed penalty in accordance with the notice.
  • A fixed penalty is payable within 14 days from the date of the fixed penalty.
  • Payment of the fixed penalty shall be
    • made to the clerk of the District ‘A’ magistrate’s court; and
    • accompanied by the completed notice.

3.(1) A member of the Barbados Police Service shall require the owner or person in charge of any kite, aircraft, drone or any other aerial object found flying in contravention of regulation 2 to cause that kite, aircraft, a drone or any other aerial object to cease flying immediately and the owner or person in charge of that kite, aircraft, drone or any other aerial object shall comply with the direction of the member of the Barbados Police Service.

  • Where a person fails or refuses to comply with a direction given by a member of the Barbados Police Service under paragraph (1);
    • that person is guilty of an offence and is liable on summary conviction to a fixed penalty of $500; and
    • regulation 2(3) to (8) and the Schedule shall apply mutatis mutandis.
  • A fixed penalty may be recovered as a debt due to the State in civil proceedings before a Magistrate for District ‘A’.
  • These Regulations shall come into effect on the 1st day of June, 2024 and shall cease to have effect on the 30th day of June, 2024

Cash should be paid to the clerk. Cheques, postal orders or money orders may be sent by post and made payable to the clerk of the magistrate’s court of District  . A receipt for the payment will be given. Part payment will not be accepted by the clerk.

The person paying the fixed penalty  must  forward  with  the  remittance  Section  B  of this notice or identify this notice by quoting its serial number.

A fixed penalty may be recovered as a debt due to the State in civil proceedings before a Magistrate for District “A”.
