APPROPRIATION ACT, 2026
OBJECTS AND REASONS
This Bill would provide for the grant of a sum of money out of the Consolidated
Fund and the appropriation of the same for the service of Barbados for the Year
ending 31st March, 2027.

A Bill entitled
An Act to grant a sum of money out of the Consolidated Fund and to
appropriate the same for the service of Barbados for the Year ending 31st
March, 2027.
ENACTED by the Parliament of Barbados as follows:
1. This Act may be cited as the Appropriation Act, 2026.
Grant of $3,447,929,400
2. The Accountant General may, on the warrant of the Minister or a
person authorised by the Minister in writing, issue out of the Consolidated Fund
and apply towards making good the supply granted for the service of the year
ending 31st March, 2027, a sum not exceeding in the aggregate $3,447,929,400.
Appropriation
3. The sum referred to in section 2 is hereby appropriated for the services
and purposes set out in the Schedule in accordance with section 109(1) of the
Constitution and is so appropriated as from 1st April, 2026.
Date on which grant takes effect
4. The date on which the grant of the sum referred to in section 2 takes
effect, is 1st April, 2026.

CRIMINAL RECORDS (REHABILITATION OF OFFENDERS)
(AMENDMENT) ACT, 2026
OBJECTS AND REASONS
This Bill would amend the Criminal Records (Rehabilitation of Offenders)
Act, Cap. 127A to
(a) exclude certain serious offences from the application of the Act;
(b) exclude offenders who had their records expunged from obtaining
further expungement;
(c) clarify the law as it relates to suspended custodial sentences;
(d) change the rehabilitation periods; and
(e) provide for related matters.

An Act to amend the Criminal Records (Rehabilitation of Offenders) Act,
Cap. 127A.
ENACTED by the Parliament of Barbados as follows:

Short title
1. This Act may be cited as the Criminal Records (Rehabilitation of
Offenders) (Amendment) Act, 2026.
Amendment of section 3 of Cap. 127A
2. Section 3(4A) of the Criminal Records (Rehabilitation of Offenders)
Act, Cap. 127A, in this Act referred to as the principal Act, is amended in
paragraph (a) by deleting the word “3” wherever it appears and substituting
the word “7”.
Amendment of section 5 of Cap. 127A
3. Section 5(2) of the principal Act is deleted and the following
substituted:
“(2) Subject to subsection (3), a rehabilitation period referred to in
subsection (1) shall commence, in the case of
(a) a custodial sentence,
(i) from the date of the release from custody; or
(ii) where the sentence was suspended, from the day
following that in which the sentence was completed,
provided that there has been no breach of the suspended
sentence; and
(b) a non-custodial sentence, from the date of the conviction.”.
Amendment of section 7 of Cap. 127A
4. Section 7 of the principal Act is amended
(a) in subsection (2), by deleting the words “Governor-General’s” and
substituting the word “Court’s”; and

(b) by inserting after subsection (2), the following:
“(2A) A person shall be excluded from rehabilitation under this Act
where, after the commencement of the Criminal Records
(Rehabilitation of Offenders) (Amendment) Act, 2026 (Act 2026- ), the
person is convicted of any of the following criminal offences:
(a) treason;
(b) an offence under section 3, 3A, 4 or 12A of the Anti-
Terrorism and Counter-Proliferation of Weapons of Mass
Destruction Act, Cap. 158;
(c) murder;
(d) rape;
(e) an offence relating to the care and protection of children and
vulnerable persons;
(f) an offence relating to pornography in which a child is a
victim; and
(g) an offence under section 3(9), 7(3) or 29(1) of the Firearms
Act, Cap. 179. ”.
Insertion of new section into Cap. 127A
5. Part II of the principal Act is amended by inserting after section 20,
the following:
“Limitation on expungement
20A. Notwithstanding any other provision of this Act, a person
whose spent conviction is expunged from the records shall not be
eligible for further expungement in relation to other convictions.”.

Amendment of section 21 of Cap. 127A
6. Section 21 of the principal Act is amended by deleting the words
“Governor-General” wherever they appear and substituting the word
“President”.
Amendment of First Schedule to Cap. 127A
7. Part I of the First Schedule to the principal Act is deleted and the
Part contained in the Schedule to this Act is substituted.

OBJECTS AND REASONS
This Bill would provide for
(a) the acquisition by the State pursuant to section 16(4) of the
Constitution in the public interest of certain properties owned by the
National Housing Corporation; and
(b) the vesting of the properties in the persons who qualify under the
National Housing Corporation (Transfer of Terrace Units) Act, 2013
(Act 2013-1) for the transfer of ownership of the properties to them.

An Act to provide for the acquisition by the State pursuant to section 16(4)
of the Constitution in the public interest of certain properties owned by the
National Housing Corporation and the vesting of the properties in the persons
who qualify under the National Housing Corporation (Transfer of Terrace
Units) Act, 2013 (Act 2013-1) for the transfer of ownership of the properties
to them.
ENACTED by the Parliament of Barbados as follows:

Short title
1. This Act may be cited as the State (Acquisition and Vesting of
Property) Act, 2026.
Interpretation
2. In this Act
“building estate” means any land described under the heading “Description of
Land” at the beginning of a Part of the Schedule, together with all the terrace
units thereon;
“person” includes the estate of a deceased person, whether or not a personal
representative has been appointed by the Court;
“terrace unit” has the meaning assigned to it by section 2 of the National Housing
Corporation (Transfer of Terrace Units) Act, 2013 (Act 2013-1).
Act binds the State
3. This Act binds the State.
Vesting of property
4.(1) Pursuant to section 16(4) of the Constitution, each property, together
with the terrace unit thereon, owned by the National Housing Corporation
established by the Housing Act, Cap. 226, set out in the first column of a Part of
the Schedule, and more particularly described and shown and delineated on the
Key Plan referred to in that Part, is vested in the State without further assurance.
(2) Each property, together with the terrace unit thereon, acquired by the State
under subsection (1), set out in the first column of a Part of the Schedule, and
more particularly described and shown and delineated on the Key Plan referred
to in that Part, is vested in the person who qualifies under the National Housing
Corporation (Transfer of Terrace Units) Act, 2013 (Act 2013-1) for the transfer
of ownership of the property to him and whose name is set out opposite the

property in the second column of that Part, together with the easements and
appurtenances thereto.
Effect of vesting
5.(1) Nothing in the Property Act, Cap. 236, the Planning and Development
Act, 2019 (Act 2019-5) or any other enactment to the contrary shall apply to a
vesting of property under this Act.
(2) A vesting of property under this Act
(a) vests in the person a good and marketable title for a fee simple absolute
in possession free from encumbrances; and
(b) discharges the person’s interest from all estates, rights, interests, liens
and encumbrances of all persons and the State.
(3) Subsection (2) does not affect the common law relating to easements of
necessity where such easements exist.
(4) Notwithstanding subsection (2), for the avoidance of doubt a vesting of
property under this Act shall in no way operate to permit the person in whom the
property is vested to restrict access to areas used legitimately
(a) in common with owners or tenants of neighbouring units of the building
estate on which the property is situate;
(b) by any public utility or government agency; or
(c) by members of the public.
