OBJECTS AND REASONS
This Bill would
- make provision for the establishment of a body corporate to be known as Business Barbados by coordinating and carrying out functions in relation to specified corporate and intellectual property enactments in order to provide efficient, effective and timely service to users; and
- repeal the Corporate Affairs and Intellectual Property Office Act, Cap. 21A,
and provide for related matters.

An Act to establish a body corporate to be known as Business Barbados by coordinating and carrying out functions in relation to specified corporate and intellectual property enactments and to provide for related matters.
ENACTED by the Parliament of Barbados as follows:
Short title 1.
This Act may be cited as the Business Barbados Act, 2024.
Interpretation
- In this Act,
“Business Barbados” means the body established by section 5; “Board” means the Business Barbados Board established by section 7;
“Chief Executive Officer” means the Chief Executive Officer appointed pursuant to section 11;
“Committee” means the Advisory Committee on Intellectual Property established by section 19;
“Director of IP” means the Director of Business Barbados Intellectual Property; “Fund” means the Business Barbados Fund established by section 21; “Minister” means Minister responsible for Business;
“Registrar” means Registrar of Companies;
“specified enactments” means the Acts specified in the First and Second Schedules and any statutory instruments made thereunder.
Act to bind State
- This Act binds the State.
Construction of specified enactments
- The specified enactments shall be construed with such modifications,
adaptations, qualifications and exceptions as may be necessary to bring them into conformity with this Act.
PART II ESTABLISHMENT, FUNCTIONS AND

Establishment of Business Barbados
5.(1)

There is established a body to be known as “Business Barbados”.
Business Barbados is a body corporate to which section 21 of the
Interpretation Act, Cap. 1 applies.
Functions of Business Barbados

The functions of Business Barbados are to administer this Act;
advise the Government and other public authorities on matters relating to this Act; and
do such other things as are necessary to give effect to this Act.
- Business Barbados shall do all things necessary or convenient to be done
in connection with the performance of its functions.
- Business Barbados shall, in the exercise of its functions pursuant to
subsection (1), administer and carry out functions relating to the specified enactments with such modifications, adaptations, qualifications and exceptions as may be necessary to bring them into conformity with this Act.
Establishment of Board
7.(1)
There is established a board, to be known as the “Business Barbados
Board”, which shall be responsible for the policy, organization and administration of Business Barbados.
(2) The Third Schedule has effect with respect to the constitution of the Board
and otherwise in relation thereto.
Functions of Board

The functions of the Board are
the appointment of staff to Business Barbados and the management thereof;
the management of the resources and contracts of Business Barbados;
the development of policies for the prudent and efficient management of Business Barbados; and
the monitoring of the performance of Business Barbados in respect of the discharge of its functions.
- For the purpose of subsection (1) the Board shall
- provide strategic direction and policy guidance to Business Barbados;
- ensure compliance with relevant laws, enactments, and government policies;
- oversee the budget and financial affairs of Business Barbados;
- participate in the development and review of Business Barbados’ strategic plans, policies and programmes;
- advise on the alignment of Business Barbados’ initiatives with national development goals;

foster collaboration with relevant government agencies, private sector organizations, research institutions and other stakeholders;
promote public-private partnerships to drive innovation and industry growth;
monitor the performance of Business Barbados against strategic objectives and key performance indicators;
review and assess the annual reports and financial statements of Business Barbados;
identify and address potential risks and challenges related to the activities of Business Barbados; and
ensure the implementation of effective risk management strategies.
Board may delegate functions
9.(1)
The Board may delegate such of its functions as it thinks expedient
for the purpose of effectively transacting the business of the Board to the Chairman, a committee of the Board or the Chief Executive Officer of Business Barbados.
- The delegation of a function under subsection (1)
- does not prevent the Board from discharging that function; and
- the Board may at any time revoke the delegation.
Staff of Business Barbados and establishment of divisions

The staff of Business Barbados shall comprise: a Chief Executive Officer;
the Registrar;
the Director of IP;
a Senior Legal Counsel;
- a Legal Counsel;
- a Legal Administrator; and
- such other staff as Business Barbados considers necessary for giving effect to this Act.
(2) For the purposes of this Act, Business Barbados may separate its
operations into divisions.
Chief Executive Officer
11.(1)
The Board shall, with the approval of the Minister, appoint a Chief
Executive Officer of Business Barbados.
- The Chief Executive Officer
- shall hold office for a term not exceeding 4 years but is eligible for reappointment;
- is entitled to such remuneration and allowances as the Board determines; and
- shall not be removed from office without the approval of the Minister.
Functions of Chief Executive Officer

The functions of the Chief Executive Officer are to discharge the functions of Business Barbados;
execute the policy and manage the affairs of Business Barbados;
inform the Minister of any matter that may affect public policy or materially affect the affairs of Business Barbados;
perform such other functions as the Board determines;
lead strategy, build talent and teams and regularly engage stakeholders; and
develop policy and business facilitation products.
- The Chief Executive Officer is, in the exercise of the Chief Executive
Officer’s functions, subject to the directions of the Board.
- Notwithstanding subsection (2), the Board shall not give directions to the
Chief Executive Officer, Registrar, Director of IP or any other person with respect to the administration of any of the specified enactments and, in particular, in the exercise of a function conferred or delegated under any of the specified enactments.
Functions of Registrar

The Registrar is responsible for
administering and ensuring compliance with this Act and the specified enactments set out in the First Schedule;
advising the Chief Executive Officer and the Board on legal matters relating to the specified enactments referred to in paragraph (a);
instituting legal proceedings in matters relating to breaches of the specified enactments referred to in paragraph (a) after consultation with the Board; and
doing any other act or thing required to be done by the Chief Executive Officer.
(2) Notwithstanding anything to the contrary in this Act, but subject to
subsection (1)(b) and (c) and any provision of a specified enactment in the First Schedule, the Registrar shall not be answerable to the Chief Executive Officer, the Board or the Minister in the exercise of the duties, obligations, powers or rights conferred on the Registrar by any of the specified enactments.
Functions of the Director of IP
14.(1)
(a)
The Director of IP is responsible for:
administering and ensuring compliance with this Act and the specified enactments set out in the Second Schedule;
- advising the Chief Executive Officer and the Board on legal matters relating to the specified enactments referred to in paragraph (a);
- instituting legal proceedings in matters relating to breaches of the specified enactments referred to in paragraph (a) after consultation with the Board; and
- doing any other act or thing required to be done by the Chief Executive Officer.
(2) Notwithstanding any provision of this Act but subject to subsection (1)
(b) and (c) and any provision of any specified enactment set out in the Second Schedule, the Director of IP shall not be answerable to the Chief Executive Officer, the Board or the Minister in exercise of the duties, obligations powers or rights conferred on the Director of IP by any of the specified enactments.
Transfer and secondment of employees
15.(1)
Where a public officer is seconded to a post in Business Barbados
from a pensionable office within the meaning of section 2 of the Pensions Act, Cap. 25, the period of service with Business Barbados, unless the President otherwise determines, counts for pension under that Act as if the officer had not been so seconded.
- Where a public officer accepts employment with Business Barbados,
- the public officer shall be employed as a permanent employee on terms and conditions that are no less favourable than those on which the officer was employed before the commencement of this Act;
- the public officer shall retain any right to pension, gratuity or other allowance for which the officer would have been eligible had the officer remained in the public service;
- the public officer’s service in the public service before the commencement of this Part shall be aggregated with his service in the Board for the purposes of paragraph (d); and
- the public officer’s right to pension, gratuity and other allowances shall be calculated in accordance with the Pensions Act, Cap. 25.
Limitation on powers of Board concerning staff, etc.
- Notwithstanding the powers conferred on the Board by section 8, the
Board shall not, without the prior approval of the Minister,
- assign to a post established by Business Barbados a salary in excess of such amount per annum as the Minister may determine;
- appoint a person to a post established by Business Barbados to which a salary in excess of the amount determined by the Minister under paragraph (a) is assigned; or
- provide for the payment of a pension, gratuity or similar benefit to the directors of the Board or the employees of Business Barbados in respect of service to Business Barbados.
Private pension plan
- Business Barbados shall, no later than 12 months after the
commencement of this Act, provide for the establishment and maintenance of a pension plan for the benefit of the staff of Business Barbados.
Appointment of experts
- Business Barbados may appoint, on such terms and conditions as the
Minister approves, such experts as it considers necessary to assist it in such manner as it determines.
Advisory Committee on Intellectual Property
19.(1)
There is established a Committee to be known as the “Advisory
Committee on Intellectual Property”.
(2) The Fourth Schedule has effect with respect to the constitution of the
Committee and otherwise in relation thereto.
Functions of the Committee

The functions of the Committee are to advise the Board on policies relating to intellectual property rights in Barbados;
matters relating to the specified enactments set out in the Second Schedule;
the status of Barbados’ compliance with intellectual property treaties and conventions; and
such other matters relating to intellectual property rights in Barbados, including matters relevant to Barbados’ economic and cultural interests,
as the Board may direct.
Establishment of Fund
21.(1)
For the purposes of this Act, the Business Barbados Fund is
established.
- The Fund shall comprise an initial capitalization amount agreed between
the Board and the Government which shall be vested in Business Barbados and such other amounts as may
- be voted for the purpose by Parliament;
- be collected as fees paid to Business Barbados pursuant to the specified enactments;
- be borrowed by Business Barbados for its purposes;
- be realized from the proceeds of its investments; and
- become available to Business Barbados from any other source approved by the Minister.
- Notwithstanding any enactment to the contrary, all fees collected by
Business Barbados pursuant to the specified enactments shall be retained by Business Barbados and paid into the Fund.
- The resources of the Fund shall be applied in payment or discharge of its
expenses, obligations and liabilities and towards the performance of its functions.
- Business Barbados
- shall develop an investment policy in relation to its resources; and
- may invest any sums not required for the purposes of subsection (4) in such low-risk securities as it considers appropriate.
Borrowing power
22.(1)
Business Barbados may, with the approval of the Minister, borrow
any money it requires for meeting any of its obligations or performing any of its functions and shall, in such a case, inform the Minister of
- the amount and source of the loan; and
- the terms and conditions on which the loan may be obtained.
(2) The approval of the Minister under subsection (1) may be general or
limited to a particular borrowing.
Guarantee of loans
23. The Government may, with the approval of Parliament, in such
manner and on such terms and conditions as may be specified, guarantee a loan to Business Barbados together with any interest or other charges payable thereon.
Exemption from taxes
24.

Accounts 25.(1)

Business Barbados is exempt from the payment of corporation tax and
Business Barbados shall, in respect of its affairs and functions keep proper accounts and adequate financial and other records; and prepare financial statements in respect of each financial year,
in conformity with generally accepted accounting practice.
- For the purposes of subsection (1), “generally accepted accounting
practice” means
- the International Public Sector Accounting Standards issued by the International Federation of Accountants;
- where no guidance is provided by the Standards referred to in paragraph (a), the Accounting Standards issued by the International Accounting Standards Board; or
- where no guidance is provided by the Standards referred to in paragraph (a) or (b), accounting practice that is generally accepted within the accounting profession in Barbados as appropriate for reporting by the public sector, including statutory bodies.
(2)
The Auditor-General shall be the auditor of Business Barbados.
The Auditor-General shall
- audit annually the accounts of Business Barbados and report to the Business Barbados and the Minister on the financial statements of Business Barbados;
- periodically assess, on such basis as the Auditor-General may determine to be reasonable, the fairness and reliability of the information submitted to the Auditor-General by Business Barbados; and
- provide the Minister and Business Barbados with copies of reports of audits and assessments carried out under this section.
Public Finance Management Act to apply
- The Public Finance Management Act, 2019 (Act 2019-1) applies to
Business Barbados with such modifications and adaptations as may be necessary.
Reports
28.
Business Barbados shall, not later than 3 months after the end of every
financial year, submit to the Minister a report containing
- an account of the activities and transactions of Business Barbados throughout the financial year in such detail as the Minister may direct; and
- a detailed statement of all sums remitted in accordance with section 42 of the Public Finance Management Act, 2019 (Act 2019-1).
Remuneration of directors
29. Directors, other than ex officio directors, are entitled to such
remuneration and allowances as the Minister determines.
Directors to declare interest
30.(1)
A director who is in any way, whether directly or indirectly, interested
in a matter before the Board shall declare the director’s interest to the Board.
- The Board, excluding the director whose interest was declared, shall
determine whether the interest is sufficiently material as to constitute a conflict of interest.
- Where the Board determines that the interest is such as to constitute a
conflict of interest, the director shall not
- participate in deliberations on the matter concerned; and
- be present during the deliberations.
- For the purpose of this section, a director shall be deemed to have a direct
interest in a matter where the director or the nominee or immediate relative of the director is
- a shareholder or a partner in; or
- an officer of,
a company or other body of persons having an interest in or involved in a matter before the Board.
- For the purpose of subsection (4), “immediate relative” means the spouse,
child, parent, brother or sister of a director.
- A person who fails to comply with subsection (1) is guilty of an offence
and is liable on summary conviction to a fine of $25 000, unless the director proves that the director did not know of the interest in the matter which was the subject of consideration by the Board.
- A person convicted of an offence under this section is no longer eligible
to sit on the Board.
Certain information not to be disclosed to Board
- No person shall disclose to the Board information obtained under any
of the specified enactments or prepared from information so obtained, that directly or indirectly reveals the identity of the person, organization or business to which the information relates.
Protection from personal liability
- No action or other legal proceedings shall lie personally against an
employee of, or other person acting under the direction of, Business Barbados or against a director or member for anything done in good faith or intended to be done in the execution or purported execution of this Act.
Notaries public
33.(1)
Notwithstanding the provisions of the Notaries Public Act
(Act 2024-21) any person holding or acting in an office set out in subsection (2) shall be a notary public for Barbados.
- The offices to which subsection (1) refers are:
- Registrar;
- Director of IP;
- Senior Legal Counsel;
- Legal Counsel; and
- Legal Administrator.
Corporate business plan
34.(1)
Business Barbados shall, every year, prepare and submit to the
Minister, a corporate business plan for the following year beginning on 1st April and ending on 31st March.
- The plan referred to in subsection (1) shall include
- the objectives of Business Barbados;
- the strategies that Business Barbados intends to use to achieve its objectives, including
- operational and financial strategies; and
- human resource strategies,
and their impact on overall salaries and benefits;
- the expected performance of Business Barbados, generally, and its Divisions, separately;
- the operating and capital budgets of Business Barbados, including grants and contributions and revenues from the conduct of the operations of Business Barbados generally, and its Divisions, separately; and
- any other strategic information that the Minister may require.
Ministerial directions
35.(1)
The Minister may, in writing, give to Business Barbados directions of
a general nature as to the policy to be followed in the performance of its functions; and Business Barbados shall comply with the directions.
(2) The Minister may, at any time, require Business Barbados to provide
information concerning any aspect of its administration under this Act; and Business Barbados shall provide the information.
Amendment of Schedules

Schedules.
The Minister may by order amend the First, Second, Third and Fourth
Regulations
- The Board may, with the approval of the Minister, make regulations
to give effect to the provisions of this Act and generally for the proper administration of this Act.
Transitional provisions relating to the State
38.(1)

Upon the commencement of this Act
all funds appropriated for the administration of the Corporate Affairs and Intellectual Property Office shall, by virtue of this Act, vest in Business Barbados;
all rights, powers, privileges and authorities relating to the administration of the specified enactments, that immediately before the commencement of this Act were vested in and exercisable by the State through the Corporate Affairs and Intellectual Property Office, are vested in and exercisable by Business Barbados;
all assets vested in or held by the State and used for matters relating to the administration of the Corporate Affairs and Intellectual Property Office before the commencement of this Act
- are transferred to and vested in Business Barbados and shall be used by Business Barbados for the purposes of this Act; and
- are by virtue of this Act, and without further assurance, transfer or formality, with effect from the commencement of this Act, to be held by Business Barbados for the same estate and interest and to the same extent and in the manner as the assets were vested in or held by the State immediately before the commencement of this Act.
- all liabilities incurred by the State in respect of the administration of the Corporate Affairs and Intellectual Property Office and subsisting
immediately before the commencement of this Act shall have effect as if they had been incurred by or on behalf of Business Barbados; and
- without affecting paragraph (d), all contracts made by or on behalf of the State in respect of the administration of any the Corporate Affairs and Intellectual Property Office and subsisting immediately before the commencement of this Act shall be deemed to have been made by or on behalf of Business Barbados and shall be construed with such modifications and adaptations as may be necessary to give effect to them.
(2) For the purpose of this section, the Corporate Affairs and Intellectual
Property Office means the office established by section 3 of the Corporate Affairs and Intellectual Property Office Act, Cap. 21A, now repealed by this Act.
Transitional provisions relating to civil proceedings
- All proceedings commenced before the commencement of this Act in
any court of competent jurisdiction by or against the State in connection with the Corporate Affairs and Intellectual Property Office may be continued by or against Business Barbados; and process in those proceedings may be amended accordingly.
Appeals to Minister or tribunal
- An appeal relating to any matter under a specified enactment begun
before the commencement of this Act before a Minister, tribunal or other body may be continued and process had and decisions given thereon as if this Act had not been enacted.
Consequential amendments
- The enactment set out in Column 1 of the Fifth Schedule is amended
in the respects specified in Column 2 of the Fifth Schedule.
Repeal of Cap. 21A
Cap. 21A is repealed.
Commencement
- This Act shall come into operation on a date to be fixed by
Proclamation.

Constitution of Business Barbados Board
Appointment of directors
1.(1)
(a)
(b)
The Board shall comprise no more than 9 directors as follows:
Permanent Secretary in the Ministry responsible for Business, ex officio, or nominee; and
the following persons appointed by the Minister, by instrument in writing:
- a representative of Barbados International Business Association;
- a representative of the Barbados Chamber of Commerce and Industry;
- a representative of the Small Business Association; and
- at least 3, but no more than 5 individuals with experience in industry, commerce or business.
- A director, other than an ex officio director, shall, subject to the provisions
of this Schedule
- hold office for a term not exceeding 3 years; and
- be eligible for reappointment.
- The Minister shall, pursuant to subparagraph (2), determine the term of
office of a director in such a manner that in any one year the respective terms of office of no more than 3 directors expire.
Chairman and Deputy Chairman
- The Minister shall appoint a director to be Chairman, and another to
be Deputy Chairman, of the Board.
Resignation
3.(1)
The Chairman may resign office by instrument in writing addressed
to the Minister.
- A director, other than the Chairman, may resign office by instrument in
writing addressed to the Chairman, who shall forthwith forward the instrument to the Minister.
- Resignation takes effect from the date on which the Minister receives the
instrument.
Temporary leave of absence
- The Minister may, in writing, grant leave of absence to a director.
Temporary appointment
- Where a director is, or is likely to be, unable to perform the functions
of office for more than 30 days, whether as a result of absence from Barbados, illness or other cause, the Minister may appoint a person to act in the place of the director.
Revocation of appointment

The Minister shall revoke the appointment of a director who fails to carry out any of the functions of director under this Act;
becomes of unsound mind or becomes permanently unable to perform the functions of director by reason of ill health;
is convicted of an offence involving fraud or dishonesty or, in the case of any other offence, is sentenced to a term of imprisonment;
is guilty of serious misconduct in relation to functions as director; is bankrupt or compounds with or suspends payment to creditors; or
- fails to declare interest in a matter before the Board as required by section 30.
Vacancies 7.(1)
A vacancy in the membership of the Board arises on
- the death or resignation of a director;
- the revocation of the appointment of a director; or
- the absence of a director from 4 consecutive meetings of the Board without the approval of the Minister.
(2) A person who is appointed to fill a vacancy referred to in subparagraph
- shall hold office only for the unexpired portion of the term of the former director concerned.
Disqualification to be director

The following persons are disqualified from being directors: a member of Parliament; or
a person who, were the person a director, would have to be removed from office pursuant to paragraph 6.
Gazetting of appointments
9. The appointment, resignation, death or removal from office of a
director shall be notified in the Official Gazette.
Seal and execution of documents
10.(1)
(a)
The seal of the Authority shall be
kept in the custody of the Chairman, the Deputy Chairman, the Chief Executive Officer or the person performing the functions of secretary to the Board and may be affixed to documents or instruments pursuant
to a resolution of the Board, in the presence of any 2 of the persons referred to in this subparagraph; and
(b) authenticated by the signature of the Chairman or the Deputy Chairman and the Chief Executive Officer or the person performing the functions of secretary to the Board.
- All documents or instruments made by the Board, other than those
required by law to be under seal, and all decisions of the Board shall be signified under the hand of the Chairman or the Deputy Chairman, the Chief Executive Officer or the person performing the functions of secretary to the Board.
Committees
11.(1)
The Board may appoint committees of its members or other persons
to assist it with the proper discharge of its functions.
(2) Where a person who is not a member of the Board is appointed to a
committee, the Board may, with the approval of the Minister, determine the remuneration and allowances to be paid to the person.
Meetings
12.(1)
The Board shall meet as often as may be necessary or expedient for
the transaction of its business; and such meetings shall be held at such places and times as the Board may determine.
- The Chairman, or in the event of the Chairman’s absence from Barbados
or inability to act as such, the Deputy Chairman, may at any time call a special meeting of the Board and shall call such a meeting within 7 days of the receipt of a request for the purpose addressed to the Chairman in writing and signed by not less than 3 directors.
- The Chairman, or in the Chairman’s absence, the Deputy Chairman, shall
preside at all meetings of the Board.
- Where the Chairman and the Deputy Chairman are absent from a meeting,
the directors present shall elect a director from among their number to preside at the meeting.
- Five directors shall constitute a quorum.
- The decisions of the Board shall be by a majority of votes and in a case
where the voting is equal, the Chairman or other person presiding at the meeting shall, in addition to an original vote, have a casting vote.
- Minutes of each meeting shall be kept by the person performing the
functions of secretary to the Board or by such other officer as the Board appoints for the purpose and shall be confirmed by the Board and signed by the Chairman or Deputy Chairman at the next meeting of the Board.
Attendance of non-members at meetings
- The Board may invite any person to attend any of its meetings to assist
or advise it with respect to any matter under its consideration, but a person so invited does not have a right to vote.
Board may regulate proceedings
- Subject to the provisions of this Schedule, the Board may regulate its
own proceedings.

The Committee shall comprise no more than 13 members as follows:
Permanent Secretary in the Ministry responsible for Business, ex officio, or nominee;
Permanent Secretary in the Ministry responsible for Agriculture,
exofficio, or nominee;
Permanent Secretary in the Ministry responsible for Innovation, Science and Technology, ex officio, or nominee;
Director of Intellectual Property, ex officio;
Chief Executive Officer, National Cultural Foundation, ex officio, or nominee;
Chief Executive Officer, Export Barbados, ex officio, or nominee; Solicitor General, ex officio, or nominee;
Chief Executive Officer, Copyright Society of Composers, Authors and Publishers Inc., ex officio, or nominee;
Director, Barbados Museum and Historical Society, ex officio, or nominee; and
at least 2, but not more than 4 individuals with experience in intellectual property, industry, business or innovation who shall be appointed by the Minister.
Chairman and Deputy Chairman
- The Minister shall appoint one of the members of the Committee to
be Chairman and one to be Deputy Chairman, respectively.
Meetings
3.(1)
The Committee shall meet at such times as the business of Business
Barbados requires.
- The Chairman, or in the Chairman’s absence the Deputy Chairman, shall
preside at meetings of the Committee.
- Seven members of the Committee shall constitute a quorum.
Term of appointment
4.(1)
Members of the Committee other than ex officio, members, hold office
for a period of 3 years from the date of their appointment but are eligible for reappointment on the expiration of the period of their tenure of office.
(2) The Minister shall, pursuant to subparagraph (1), determine the term of
office of a member of the Committee in such a manner that in any one year the respective terms of office of no more than 3 members of the Committee expire.
Resignation
5.(1)
The Chairman may resign office by instrument in writing addressed
to the Minister.
- A member, other than the Chairman, may resign office by instrument in
writing addressed to the Chairman, who shall forthwith forward the instrument to the Minister.
- Resignation takes effect from the date on which the Minister receives the
instrument.
Temporary leave of absence
- The Minister may, in writing, grant leave of absence to a member.
Temporary appointment
- Where a member is, or is likely to be, unable to perform the functions
of office for more than 30 days, whether as a result of absence from Barbados, illness or other cause, the Minister may appoint a person to act in the place of the member.
Revocation of appointment

The Minister shall revoke the appointment of a member who fails to carry out any of the functions under this Act;
becomes of unsound mind or becomes permanently unable to perform functions by reason of ill health;
is convicted of an offence involving fraud or dishonesty or, in the case of any other offence, is sentenced to a term of imprisonment;
is guilty of serious misconduct in relation to the member’s functions; is bankrupt or compounds with or suspends payment to creditors;
fails to declare the member’s interest in a matter that is before the Committee.
Vacancies 9.(1)
A vacancy in the membership of the Committee arises on
- the death or resignation of a member;
- the revocation of the appointment of a member; or
- the absence of a member from 4 consecutive meetings of the Committee without the approval of the Minister.
(2) A person who is appointed to fill a vacancy referred to in subparagraph
- shall hold office only for the unexpired portion of the term of the former member concerned.
Disqualification
- The following persons are disqualified from being members of the
Committee:
- a member of Parliament;
- a person who, other than a person specified in paragraph 1(1)(a),(b),
- or (g) is a public officer within the meaning of the Public Service Act, Cap. 29; or
(c) a person who, were the person a member, would have to be removed from office pursuant to paragraph 8.
Gazetting of appointments
- The appointment, resignation, death or removal from office of a
member shall be notified in the Official Gazette.
Attendance of non-members
- The Committee may invite any person to attend any of its meetings to
assist or advise it with respect to any matter under its consideration, but a person so invited does not have a right to vote.
Remuneration
- Members of the Committee, other than ex officio members, are entitled
to such remuneration and allowances as the Minister determines.

The Minister, in exercise of the powers conferred on him by section 305(1)
(p) of the Shipping (Domestic Vessels) Act, 2024, makes the following Regulations:
Citation
1.
These Regulations may be cited as the Shipping (Domestic Vessels)
(Small Commercial Vessels) Regulations, 2024.
Definitions
- In these Regulations,
“daily water sports installation” means a water sports installation that is removed from the water on a daily basis;
“monthly water sports installation” means a water sports installation that is in place for not less than 72 hours but not more than 30 days;
“permanent water sports installation” means a water sports installation that is in place for not less than 72 hours but not more than 6 months;
“short-term water sports installation” means a water sports installation that is in place for not more than 72 hours;
“water sports floating device”
- means a floating device used for the purposes of water sports; and
- includes
- an inflatable water device;
- a raft;
- a trampoline; or
- any similar floating device;
“water sports installation” means an object or device of any material filled with a gas to produce bouyancy, anchored to the sea floor and used for the purpose of recreation or water sports.
Life saving and safety equipment
3.(1)
A vessel owner or operator shall ensure that a small commercial vessel
has the following on board:
- life saving equipment including
- life jackets suitable for the size of persons on board;
- life rafts;
- life buoys of sufficient capacity to accommodate the number of persons on board;
- first aid kit; and
- flares and distress signalling equipment and apparatus; and
- fire protection equipment including
- fire extinguishers;
- fire buckets; and
- an emergency plan, in digital format or print copy.
- The items referred to in paragraph (1) shall be
- safely stored on board the vessel;
- annually inspected, serviced or tested, as the case may be; and
- be consistent with the length, type and operational circumstances of the vessel.
- A vessel owner or operator shall
- ensure that all vessels are equipped with appropriate fire detection systems and effective fire-fighting systems;
- regularly service and maintain fire-fighting systems in accordance with manufacturer’s recommendations;
- regularly check smoke and heat detectors; and
- immediately contact the Coast Guard and shore-based emergency personnel in event of a fire on board.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $20 000 and liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Life jackets and life vests
4.(1)
A vessel owner or operator shall provide a life jacket or life vest to a
hirer, a passenger and any person who, not being the vessel owner or operator, intends to operate the vessel which was hired.
- A hirer, passenger and any person who, not being the vessel owner or
operator, who operates the vessel which was hired, shall wear a life jacket or life vest while the vessel is being operated.
- A person who contravenes paragraph (1) is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- A person who contravenes paragraph (2) is guilty of an offence and is liable
on summary conviction to a fine of $5 000.
Navigation equipment
5.(1)
A vessel owner or operator shall ensure that a small commercial vessel
is equipped with the following:

GPS or any other tracking device or system; one pair of binoculars;
navigational lights;
a table of life saving signals;
a signalling lamp suitable for Morse Code; a radar;
a radar reflector;
a flag of Barbados; and
any other equipment as may be necessary for the safe navigation of the vessel.
- The equipment on board shall be consistent with the length, type and
operational circumstances of the vessel.
- Small open water crafts and submersible vessels are exempted from the
requirement at paragraph (1)(a).
- A vessel owner or operator shall make available any GPS or equivalent
tracking device, system or information where it is requested by an authorised person.
- A vessel owner or operator shall
- ensure that all crew are trained to manage the navigation and communication equipment;
- ensure alternative power sources, including batteries for navigational and communication equipment, where such equipment is linked to a single power source;
- ensure there is an adequate supply of battery operated equipment; and
- accurately and effectively communicate the location of the vessel to Coast Guard and other rescue and support services to enable safe and swift vessel assistance.
- Where a vessel is to operate in the night or any period of darkness, a vessel
owner or operator shall
- install navigation lights on the vessel;
- ensure that the vessel’s navigation lights are used; and
- regularly check that the lights are functioning.
- Where practicable, all jet skis and water sports craft shall be equipped with
a mirror on the left and right sides.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Radio communication equipment
6.(1)
A vessel owner or operator shall ensure that a small commercial vessel
is equipped, where practicable, with radio communication equipment including a high frequency radio.
- The radio equipment on board shall be consistent with the type and
operational circumstances of the vessel.
- A vessel owner or operator shall ensure that the vessel’s radio
communication equipment is regularly checked and functioning.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Radar reflector
7.(1)
(a)
(b)
A vessel owner or operator shall ensure that
a small commercial vessel is equipped, where practicable, with a radar reflector or an equivalent device to enable detection by other vessels; and
the radar reflector is installed in accordance with the manufacturer’s instructions and as high as is necessary for maximum detection rang
- Notwithstanding paragraph (1), a small commercial vessel operating
between sunrise and sunset shall be exempted from the requirement at paragraph (1).
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purposes of this regulation, “radar reflector” means a device which
enables detection by vessels navigating by radar.
Vessel monitoring system
8.(1)
A vessel owner or operator shall ensure that a small commercial vessel
is equipped, where practicable, with a vessel monitoring system.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purpose of this regulation, “vessel monitoring system” means a
system used to monitor the movement of a vessel.
Table of life saving signals
9.(1)
A vessel owner or operator shall ensure that a small commercial vessel
is equipped with a table of life saving signals.
(2) A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
General safety procedures
10.(1)
(a)
(b)
No person other than
the master or a crew member assigned to the deck of a small commercial vessel shall take charge of watch on the deck of that vessel; or
a crew member of a small commercial vessel who is an engineer shall take charge of watch in the engine room of that vessel.
- Prior to the commencement of any voyage, the master of small commercial
vessel shall advise the passengers on board of the following:
- the emergency procedures in the event of
- a collision of the vessel at sea;
- any other accident at sea;
- the location and availability of the life-saving equipment;
- the instructions for utilizing the life-saving equipment;
- the location of muster stations; and
- any other relevant information.
- An operator of a small commercial vessel shall comply with the emergency
procedures for safety of life at sea.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Vessel kill switch
11.(1)
A vessel owner or operator shall ensure a water sports craft not
exceeding 4 metres in length is
- fitted with a switch hereinafter referred to as a “kill switch”
- designed to disable or turn off the engine where the driver has lost control of the water sports craft; and
- designed with lead to be attached to the wrist or ankle of the operator of the craft; and
- fitted with a device designed to return the water sports craft’s throttle to idle where the kill switch malfunctions.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
First aid station
12.(1)
An operator shall establish and maintain a first aid station or a joint
first aid station, as the case may be,
- along the route where he normally operates the vessel; or
- at such other place approved by the Administration.
- A person may apply to the Administration in the form and manner
specified.
- Where a person has satisfied the requirements of an application, the
Administration shall approve, in writing, the establishment of a first aid station or a joint first aid station, as the case may be.
- The approval referred to in paragraph (3) may be subject to terms,
conditions and restrictions.
- A first aid station or joint first aid station shall be clearly identified as such.
- A joint first aid station shall be jointly maintained and operated by such
persons specified in the approval.
- A first aid station or joint first aid station shall
- be equipped with life saving equipment including
- life jackets and life buoys;
- first aid kit, oxygen tanks and suitable masks; and
- any other equipment or medical supplies that the Administration may specify; and
- be operated by a person suitably qualified in first aid procedures, including cardiopulmonary resuscitation.

- For the purpose of this regulation, “first aid station” means the area or
location that provides emergency care or treatment before regular medical aid can be obtained.
Operating a vessel at a safe speed
13.(1)
(2)
All persons shall operate a small commercial vessel at a safe speed.
In establishing a safe speed, an operator shall take into account
- visibility;
- maritime traffic density;
- manoeuvrability of the vessel;
- background light at night;
- proximity of navigational hazards;
- draught of the vessel;
- limitations of radar equipment; and
- weather conditions.
- All persons operating a vessel shall reduce speed when approaching or
passing the following:
- a vessel under way, lying to, at anchor or made fast to the shore;
- a sea user;
- a person engaged in a water sports activity; or
- boat ramps, boat houses, piers, docks, swimming areas, near-shore fishing areas, designated marine areas and the shoreline.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purpose of this regulation, “safe speed” means the speed at which
a vessel is operated by an operator who can
- take proper and effective action to avoid a collision; and
- stop the vessel within a distance appropriate to the prevailing circumstances and conditions.
Operating a vessel in no-wake zones
14.(1)
No person shall operate a small commercial vessel in excess of the
maximum speed in a no-wake zone.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Operating a vessel in prohibited areas
15.(1)
No person shall operate a small commercial vessel or conduct water
sports activities in a prohibited area.
- Where it is necessary for a small commercial vessel to enter a prohibited
area for the purpose of anchoring, refuelling or beaching, such vessel shall be driven at a speed not exceeding 5 knots.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Routes for entry and exit
16.(1)
An operator of a small commercial vessel shall use the route for entry
to and exit from the area designated for water sports activities.
- The route referred to in paragraph (1) shall be demarcated by buoys.
- Notwithstanding paragraph (1), a vessel may be permitted to use a route
other than the route for entry to and exit from the area designated for water sports activities in the following circumstances:
- a medical emergency;
- an environmental emergency;
- adverse weather; or
- a navigational hazard.
- Where a vessel uses a route other than the route for entry to and exit from
the area designated for water sports activities, an operator shall not operate the vessel
- in an unsafe speed or in an unsafe manner; or
- in close proximity to any other sea users including swimmers, divers, sea bathers or other water craft users.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Prohibition of activities in routes for entry and exit
17.(1)
No person shall swim, bathe or conduct any other activity in an entry
or exit route designated for water sports activities.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Diving
18.(1)
Subject to this regulation, a person who dives with or without a snorkel
shall have a ballasted orange float which shall be fitted with
- a mast so as to be in an upright position when afloat; and
- a dive flag.
- The float referred to in paragraph (1) shall be anchored in the area in which
the diving is taking place.

A diver shall dive not more than a radius of 25 metres away from the

- in the case of drift diving, 60 metres from the dive vessel and the diver.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purposes of this regulation,
“dive flag” means
- a rectangular flag with a white diagonal stripe running from the upper left corner to the lower right corner against a red background;
- an alpha flag being a flag with a swallow tail shape, which is white vertically to the hoist and blue to the fly; and
- any other flag which is internationally recognized;
“drift diving” means dives from a vessel where the divers drift for the majority of the dive and where the vessel does not remain moored during the dive.
Area for bathing and diving
19.(1)
A person may apply, in writing, to the Administration for permission
to enclose, by means of buoys, any area in a harbour for the purpose of bathing or diving.
- The Administration may, with the approval of the Minister, grant
permission to enclose by means of buoys any area in a harbour to be used exclusively for the purpose of sea-bathing or diving.
- All buoys placed in a harbour for the purpose mentioned in paragraph (1)
shall be placed within 60 metres from the shore and shall be
- orange in colour; and
- not less than 30 centimetres in diameter.
- The Director shall cause to be erected on the land immediately adjoining
the foreshore of any area where buoys are placed by virtue of paragraph (1) not fewer than 3 copies of a notice
- printed in red letters and figures on a white background, not less than 60 centimetres long by 45 centimetres wide;
- affixed to an upright pole not less than 1.8 metres high; and
- bearing the words
“CAUTION
PERSONS ARE ENGAGED IN WATER SPORTS ACTIVITIES SUCH AS JET-SKIING, WATERSKIING AND SURFING OUTSIDE THE AREA MARKED WITH ORANGE COLOURED BUOYS. DIVERS AND SWIMMERS SHOULD PROCEED WITH CAUTION”.
Operating a vessel in designated bathing and diving areas
20.(1)
No person shall operate a vessel or engage in water sports activities
in an area designated for bathing or diving.
(2) A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Route to water sports activities
21.(1)
An operator of a small commercial vessel used for water sports
activities shall proceed seaward for at least 200 metres from the shore before any water sports activity is undertaken by the use of that vessel.
- Notwithstanding paragraph (1), an operator of a small commercial vessel
used for water-skiing only shall proceed seaward for at least 75 metres from the shore before any water-skiing is undertaken by the use of that vessel.
- Paragraph (2) shall not apply for the purpose of taking a child water-skiing.
- Where water-skiing commences close to the shore, the water sports craft
shall not be operated
- in an unsafe speed or in an unsafe manner; or
- in close proximity to any other sea users including swimmers, divers, sea bathers or other water craft users.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Night water taxi services
22.(1)
A vessel owner or operator of a small commercial vessel, except a jet
ski, may engage in night water taxi services where
- there is a valid certificate of seaworthiness in respect of the vessel;
- there is a valid insurance policy or an equivalent form of security in respect of the vessel;
- the vessel is equipped with appropriate navigational lights; and
- the vessel complies with the requirements of the Act and its statutory instruments.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purpose of this regulation, “night” refers to the period from sunset
to sunrise.
Time to remove water sports craft
23.(1)
Subject to these Regulations, no person shall operate a water sports
craft for commercial purposes or water sports activities after sunset.
- An operator shall be permitted a 30 minute period after sunset to operate
a water sports craft for the purpose of removing the water sports craft from the water.
- No person shall operate a water sports craft for commercial purposes or
water sports activities within the 30 minute period referred to in paragraph (2).
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Towing requirements
24.(1)
No person who operates a water sports craft shall tow a vessel or a
person in an unsafe manner or without an observer on board.
(2) A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Operating a vessel under the influence
25.(1)
(a)
(b)
No person shall
operate a vessel while he is under the influence of alcohol or a controlled drug; or
allow a person to operate a vessel who is under the influence of alcohol or a controlled drug.
- A maritime law enforcement officer may detain or impound a vessel where
he has reason to believe that a vessel is operated by a person who is under the influence of alcohol or a drug.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Prohibition of dangerous activities
26.(1)
unless
(a)
No person may operate a vessel within a 15 metres of another vessel
such vessel is
- owned by the State or a statutory board; or
- involved in an organized and approved racing competition or display; or
(b) for the purpose of rendering assistance, transferring passengers or cargo or connecting a tow.
- A vessel shall be stationary when transferring passengers or cargo or
connecting a tow.
- No person on board a vessel shall cling to or board another vessel, whether
at anchor or underway, without the prior permission of the owner or operator of the other vessel.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Misconduct of operators
27.(1)
An operator shall conduct himself in an appropriate manner while
engaging in activities at sea.
- No operator shall
- use abusive language towards a customer, potential customer, sea user or operator;
- harass a person with a view of engaging that person as a potential customer;
- bully another operators lawfully conducting business in the marine environment; or
- assault any person including sea users, potential customers, operators lawfully conducting business in the marine environment.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Misconduct of persons
28.(1)
No person shall assault, harass, bully or use abusive language to a
person in the marine environment.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000.
Age requirements
29.(1)
No person shall hire or operate a water sports craft unless he is 16
years of age or older.
- A person who wishes to hire or operate a water sports craft shall present a
valid form of identification evidencing he is 16 years of age or older.
- No vessel owner or operator shall hire a water sports craft to a hirer unless
that person presents a valid form of identification evidencing he is 16 years of age or older.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000.
Operating instructions
30.(1)
No operator shall hire or allow a water sports craft to be operated by
another person unless
- he notifies that person orally and in writing of the operating instructions set out in the Schedule; and
- the hirer or the person who is to operate the water sports craft has signed a copy of the operating instructions indicating that he has been instructed as indicated.
- An operator shall not hire a water sports craft unless he has received a
signed copy of the operating instructions by the hirer or the person who is to operate the water sports craft.
- A hirer or a person who is permitted to operate a water sports craft shall
sign a copy of the operating instructions indicating that the operator has instructed him as indicated.
- Where practicable, a hirer shall ensure that the operating instructions are
kept on board a water sports craft during the period of hire.
- A hirer or person who is to operate a water sports craft shall
- comply with the operating instructions; and
- operate the water sports craft in accordance with the operating instructions.
- A person who contravenes paragraph (1), (2) or (3) is guilty of an offence
and liable on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- A person who contravenes paragraph (5) is guilty of an offence and is liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Waiver forms
31.(1)
No operator shall hire a water sports craft or water sports device to a
hirer unless he
- provides a waiver form to a hirer;
- receives a completed and signed waiver form from the hirer; and
- provides operating and safety instructions to the hirer.
- All hirers shall sign and return the completed waiver form referred to in
paragraph (1) to the operator.
- A waiver form shall contain the following information:
- the full name of each hirer;
- the address of the hirer in Barbados;
- the address of the hirer abroad, where applicable;
- a declaration by each hirer or person who will operate the small commercial vessel, that the water sports craft or water sports device is being used at his own risk;
- a declaration by each hirer or person who will operate the small commercial vessel, as to his medical fitness to operate a water sports craft or water sports device;
- a declaration by each hirer or person who will operate the small commercial vessel that the operator of the water sports craft or water sports device has provided him with operational and safety instructions including the following:
- prohibited areas;
- designated marine areas;
- no-wake zones;
- operational and maritime safety information to sea users and vessels; and
- any other information as may be specified by the Administration.
- a declaration by each hirer or person who will operate the small commercial vessel that the operator of the water sports craft or water sports device has provided him with operational and safety instructions including the following:
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Notice of water sports activities
32.(1)
The Administration shall give notice of an area where water sports
activities are being conducted.
(2)

All divers, swimmers and other sea users are to proceed with caution
- an area is demarcated by buoys for the purpose of sea bathing or diving; and
- water sports activities are conducted in close proximity to the demarcated area.
Water sports installation
33.(1)
A person who wishes to install a water sports installation shall obtain
a water sports installation permit.
- All water sports installations shall
- comply with general requirements for safety of life at sea;
- not endanger the marine environment; and
- not obstruct other sea users.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $ 20 000.
Application
34.(1)
A person may apply to the Administration for a water sports
installation permit.
- An application shall be
- in writing;
- accompanied by the relevant fees; and
- made no less than 30 days before the intended installation date.
Issuance
35.(1)
Where an applicant has met the requirements and paid the prescribed
fees, the Administration shall issue a water sports installation permit.
- A water sports installation permit may be subject to such terms, conditions
and restrictions as may be specified by the Administration.
A water sports installation permit may be renewed.
- A person may apply to renew a water sports installation permit in the
prescribed manner and upon paying the prescribed fee.
- The Administration shall renew a water sports installation permit where
the applicant has met the requirements for renewal.
Water sports floating devices
37.(1)
No person shall install or offer for hire in Barbados waters any water
sports floating device unless he obtains written permission from the Administration.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of 10 000.
Emergency procedures
38.(1)
(a)
(b)
A vessel owner or operator of a small commercial vessel shall
establish a general emergency plan taking into account the length, type and operational circumstances of the vessel; and
ensure compliance with the emergency procedures.
- Where practicable, all small commercial vessels shall conspicuously
display the emergency procedures for the vessel.
- A vessel owner or operator shall
- upon embarkation,
- inform passengers of the vessel’s emergency procedures; and
- ensure passengers undergo the relevant emergency drills, including notice of muster stations, use of safety equipment;
- conduct vessel emergency drills with crew frequently;
- annually review and update the vessel’s emergency procedures; and
- undertake any other necessary measures on emergency procedures.
- upon embarkation,
- An emergency procedure shall take into account the following:
- a person overboard
- safety equipment;
- emergency steering;
- water ingress;
- fire detection and fire-fighting;
- safe navigation and communication; and
- any other emergency considerations.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Person overboard
39.(1)

Before a vessel departs, a vessel owner or operator shall
identify the likely vessel operations and areas on board vessel which may result in a person falling overboard;
consider whether certain areas of a vessel should be deemed out of bounds;
ensure the wearing of a harness or tether; and
plan a watch system in the event of a reduced number of crew on deck.
- Where a person is overboard, a vessel owner or operator shall
- establish whether the person overboard is physically connected to or physically disconnected from the vessel;
- mark the position of the person overboard using a danbuoy or similar equipment to stop the vessel as safely and as quickly as possible;
- safely and quickly stop the vessel in order to minimize the risk of drowning where the person overboard is connected or tethered to the vessel;
- give specific attention to the location of the person overboard to ensure that person is clear of any risk of the vessel propeller;
- use an appropriate method of marking the person overboard where that person is disconnected from the vessel including
- electronic means such as GPS plotter or other similar device; and
- visual means such as a danbuoy deployed in the water;

alert the crew that an incident has occurred;
remain in safe and close contact with the person overboard, where possible;
ensure all recovery procedures are effected as soon incident occurs;
take all reasonable measures to recover the person who has fallen into the water including throwing a life ring or launching a rescue boat, if available; and
contact the Coast Guard and shore-based emergency personnel as soon as the incident occurs.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Emergency steering operation
40.(1)
Where practicable, all small commercial vessels shall conspicuously
display the procedure and diagram for an emergency steering operation.
- All operators shall conduct
- a routine check for proper working of manual emergency system and steering gear system; and
- an emergency steering drill every 3 months to facilitate the training of crew so that in emergency situation vessels control can be regained as soon as possible, avoiding collision or grounding.
- The following procedure shall be observed for an emergency steering
operation:
- application method of controlling the direction of thrust;
- use of an emergency tiller to fit the head of a rudder stock;
- use of a steering oar on the transom;
- manipulation of power distribution between the drives;
- water sports installation permit of a means to lock drives in mid-ship positions;
- any other appropriate emergency steering system; or
- contact the Coast Guard and emergency shore-based personnel immediately, where incident not brought under control.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Water ingress
41.(1)
An operator shall investigate water ingress on a voyage.
- The following procedure shall be observed for water ingress:
- determine the source of water ingress where water is found within interior of vessel at any time prior to, during and after any voyage of any length or duration;
- routinely inspect bilges at least once per day;
- conduct inspections of water ingress in the case of heavy weather or rough seas;
- ensure strum boxes are kept clean and free of debris;
- ensure bilges are kept as clear as practical to avoid blocking the bilge pump filters; and
- where salt water found while operating at sea, slow down or stop vessel until source has been identified.
- In the case of water ingress, an operator or boat master shall inspect the
following areas:
- any skin fitting or seacock such as a toilet discharge pipe or an echo sounder log;
- propeller shaft or sail drive interface;
- steering gear, rudder bearings and rudder stock;
- kneel bolts and surrounding structure;
- windows, hatches and port-lights;
- standing rigging attachment points on deck; and
- hull and deck joint.
- Where there is water ingress an operator shall take the following actions:
- take reasonable care for the safety of persons;
- consider any crew below decks and the stowage of any safety equipment;

consider the Emergency Position Indicating Radio Beacons (EPIRB) or emergency grab bag and potential notification of a shore contact;
thoroughly inspect all internal structural members, focusing on high areas of load or stress, such as the inner hull matrix around the keel attachments and bulkheads supporting this area;
investigate lockers, such as anchor locker for structural and watertight integrity;
identify rate of ingress against method of egress, and ensure vessel remains a safe platform to operate from;
protect cargo and other items;
check electrical security to ensure the continued safety of vessel; check the stability of the vessel;
set an emergency sail plan including changing vessel to a more favourable direction with respect to sea conditions, a reduction in speed or alteration to original sail plan;
where water ingress is manageable, determine the nearest safe haven and detail an appropriate passage plan in order to reach that destination; and
maintain close communication with Coast Guard and shore-based emergency personnel.
- A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $20 000 or to imprisonment for 2 years or to both and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
Transitional
42.(1)

(b)
Where immediately before the commencement of these Regulations
a vessel is licensed under the Barbados Harbours Regulations, 1961 (LN 1961 No. 11) to carry passengers or goods; or
an operator of a water sports craft holds a permit issued under the
Shipping (Watersports) Regulations, 2004 (S.I. 2004 No. 164),
the licence or permit, as the case may be, unless previously revoked or cancelled under those Regulations remains valid until the date fixed for its expiry.
- All licences or permits to drive water sports craft issued pursuant to the
Shipping (Watersports) Regulations, 2004 (S.I. 2004 No. 164) unless previously revoked under those Regulations, remain valid until the date fixed for their expiry.
- Any record or register of licences to drive a water sports craft and any other
record or register kept pursuant to the Shipping (Watersports) Regulations, 2004 (S.I. 2004 No. 164) shall continue to have effect as though kept pursuant to these Regulations.
- All certificates of registration, certificates of seaworthiness and any other
certificates issued under the Shipping (Watersports) Regulations, 2004 (S.I. 2004 No. 164) remain valid until the date fixed for their expiry.
- Where a vessel is being operated for the carriage of passengers for hire or
reward immediately before the commencement of these Regulations and the operator does not possess a licence under the Barbados Harbours Regulations,1961 (LN 1961 No. 11), the operator shall, where he intends to continue to operate the vessel as a passenger ferry, apply to the Director in writing, for a licence to operate the passenger ferry within 3 months of the commencement of these Regulations.
Revocation
hereby revoked.

to look out for and not to operate within 50 metres of dive flags and sail boats; to enter and exit the beach at slow speeds through the designated routes;
not to interchange riders whilst at sea;
that where 2 water sports craft are likely to collide with each other head-on, the driver is to alter his course to the starboard (right) side of the oncoming water sports craft and pass the other water sports craft on the port (left) side;
that a vessel under power should always give way to a sailing vessel;
that a vessel should always give way to another vessel on its starboard side (right side);
that any vessel overtaking another shall stay clear of the vessel being overtaken; distance permitted offshore;
speed in allowable area;
location, time and date of vessel return;

SHIPPING (DOMESTIC VESSELS) (PLEASURE VESSELS) REGULATIONS, 2024
The Minister, in exercise of the powers conferred on him by section 305(1)
(q) of the Shipping (Domestic Vessels) Act, 2024, makes the following Regulations.
- These Regulations may be cited as the Shipping (Domestic Vessels)
(Pleasure Vessels) Regulations, 2024.
2.(1)
A vessel owner or operator shall ensure that a pleasure vessel has the
following on board:
- life saving equipment including
- life jackets suitable for the sizes of persons on board;
- life rafts;
- life buoys of sufficient capacity to accommodate the number of persons on board;
- flares and distress signalling equipment and apparatus;
- fire protection equipment including
- fire extinguishers; and
- fire buckets; and
- an emergency plan in digital format or print copy.
- The items referred to in paragraph (1) shall be
- safely stored on board the vessel;
- annually inspected, serviced or tested, as the case may be; and
- consistent with the length, type and operational circumstances of the vessel.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
3.(1)
A vessel owner or operator shall ensure that a pleasure vessel is
equipped with the following:
- GPS or any other tracking device;
- one pair of binoculars;
- navigational lights;
- a table of life saving signals;
- a signalling lamp suitable for Morse Code;
- a radar;
- a radar reflector; and
- any other equipment as may be necessary for the safe navigation of the vessel.
- The navigation equipment on board a pleasure vessel shall be consistent
with the length, type and operational circumstances of the vessel.
- Navigation lights shall be used where a vessel is to operate in the night or
any period of darkness.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $20 000 and is liable to have the relevant certificate or permit, as the case may be, suspended, cancelled or revoked.
4.(1)
A vessel owner or operator shall ensure that a pleasure vessel is
equipped, where practicable, with radio communication equipment.
- The radio equipment on board a pleasure vessel shall be consistent with
the type and operational circumstances of the vessel.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.

A vessel owner or operator shall ensure that
a pleasure vessel is equipped, where practicable, with a radar reflector or an equivalent device to enable detection by other vessels.
the radar reflector is installed in accordance with the manufacturer’s instructions and as high as is necessary for maximum detection range.
- Notwithstanding paragraph (1), a pleasure vessel operating between
sunrise and sunset shall be exempted from the requirement at sub-paragraph (1).
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purposes of this regulation, “radar reflector” means a device which
enables detection by vessels navigating by radar.
6.(1)
A vessel owner or operator shall ensure that a pleasure vessel is
equipped, where practicable, with a vessel monitoring system.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $5 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
- For the purposes of this regulation, “vessel monitoring system” means a
system used to monitor the movement of a vessel.
7.(1)
A vessel owner or operator shall ensure that a pleasure vessel is
equipped, where practicable, with an illustrated table of life saving signals.
(2) A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.
8.(1)
A vessel owner or operator of a pleasure vessel shall plan a voyage
using appropriate nautical charts and nautical publications for the area concerned before proceeding on a voyage.
- In determining the degree of planning required for a voyage, an operator
shall consider
- the size of the pleasure vessel;
- the length of the voyage;
- the crew required and competence of the crew;
- any navigational hazards;
- weather forecasts including tidal predictions; and
- any relevant information.
- A voyage plan shall contain
- the name of the vessel owner;
- the name of the vessel operator;
- the date and time of the planned departure of the voyage;
- the activity scheduled;
- the number of person on board the vessel;
- the date and time of the return from the voyage;
- the route of the voyage; and
- the particulars of the recording officer.
- A voyage plan shall identify a route that
- takes into account any relevant routing systems of vessels;
- ensures adequate sea room for the safe passage of the vessel throughout the voyage;
- anticipates all known navigational hazards; and
- takes into account any marine environmental protection measures.
- A person who contravenes this regulation is guilty of an offence and is
liable on summary conviction to a fine of $5 000.
9.(1)
No person shall operate a pleasure vessel in excess of the maximum
speed in a no-wake zone.
(2) A person who contravenes this regulation is guilty of an offence and liable
on summary conviction to a fine of $10 000 and is liable to have the relevant licence, certificate or permit, as the case may be, suspended or revoked.

Citation
1.
These Regulations may be cited as the Shipping (Domestic Vessels)
(Marine Facilities) Regulations, 2024.
Definitions
2. In these Regulations,
“abrasive blasting” means the use of pressurized air or water to propel abrasive media including copper slag, garnet, glass and sand against a surface to remove coating, corrosion or contamination;
“approved waste facility” means a waste management facility approved by the Ministry responsible for the Environment.
Chemical storage

provide a secure, covered area with a surface impervious to leaks or spills to facilitate chemical storage;
establish a retaining wall around chemical storage areas;
establish chemical storage areas away from through-traffic, storm- water drains, pipes or any areas prone to flooding;

ensure that chemical storage facilities comply with the requirements of any relevant enactment and international standards;

store small quantities of chemicals to be used on-site;
store chemicals in sealed containers or apparatus away from heat, naked flames, direct sunlight, oil or other flammable liquids and fire hazards;
secure chemicals in sealed containers or apparatus appropriate to the type of chemical to be stored;
regularly inspect chemical storage containers, apparatus and equipment;
store incompatible chemicals separately;
seal and clearly label all chemical storage containers and smaller decanting containers;
where practicable, fit chemical storage containers with taps to minimize spills, drips or leakages;
remove any excess chemical from the tap to minimize spills, drips or leakages; and
place chemically compatible trays under container taps to catch spills, drips or leakages.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Chemical handling

refer to the material safety data sheet for advice and information on handling chemicals;
ensure that personnel responsible for handling chemicals are aware of the hazardous nature of the chemicals;
ensure that chemical handling complies with the relevant enactment and international standards; and

- personal protective equipment for chemical handling; and
- staff training in chemical handling procedures and the use of chemical handling equipment.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Emergency response procedures
5.(1)

A marine facility operator shall
prepare an emergency response plan that describes environmental safety provisions and emergency response procedures in the event of fire, chemical and other spills, damage to equipment and personal injury;
conspicuously display
- the emergency response plan; and
- the telephone numbers of the relevant response agency in the event of fire, chemical and other spills, damage to equipment and personal injury;

annually review the contents of the emergency response plan with the facility staff;
promptly report all spills to the relevant authorities;
keep and maintain spill clean-up equipment including absorbent materials and non-toxic dispersant booms;

as soon as it is practicable, safely contain and clean up spills or leaks; not wash the substances onto soil or into any inland or coastal waters;
not use sawdust or other readily combustible absorbents to clean up flammable chemical spills;
refer to the material safety data sheet for guidance for dealing with chemical spills;
dispose of contaminated clean-up materials in accordance with the waste management plan; and
where practicable, assist government agencies in the event of an environmental emergency.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Vessel work area
6.(1)
(a)
(b)
A person shall
undertake all vessel repair and maintenance activities on a bunded, sealed area to ensure that the wash-down wastewater and other facility liquid wastes can be fully contained on site;
where practicable, establish the work area at least one metre above the high tide mark to minimize the potential for waste materials to enter the inland or coastal waters.
- where practicable, undertake work at low tide in a bunded area;
- erect signage to draw attention to environmental management requirements;
- regularly clean and maintain the work area;
- establish a daily checklist to ensure that work areas are kept clean and comply with statutory requirements;
- where practicable, assign inspection responsibilities to facility staff or club members;
- encourage vessel owners who use a marine facility to
- fit oil filtration devices to their bilge pumps; and
- place commercial oil absorption materials in their bilges;

ensure that sumps, traps and filters operate with maximum efficiency; and
collect and retain all waste material from the work area until it can be disposed of appropriately.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Hull cleaning and stripping

A person shall
where practicable, use manual or mechanical buffing and scraping methods in preference to abrasive blasting for hull cleaning;
fit sanders, grinders and other power tools with dust extraction and collection systems;
use water-based or biodegradable strippers, cleaners and degreasers;
where practicable, use phosphate-free detergents and scrub with a soft brush to absorb the detergent;

not burn off anti-fouling coatings.

Pressure water blasting

ensure that pressure water blasting activities do not create an environmental nuisance;
prevent spray drift from escaping the work area by
- using moveable waterproof screens; and
- avoiding pressure water blasting operations during windy conditions;
- where the surface to be cleaned contains paint with more than 0.5% lead content, utilize a water proof membrane and ensure persons working in the area are protected; and
- direct wastewater runoff to a collection point.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Abrasive blasting

ensure that pressure water blasting activities do not create an environmental nuisance;
consult with the relevant agencies for details of minimum buffer distances from adjoining land uses when conducting abrasive blasting;
remove zinc anodes before abrasive blasting;
use water or other suppressant to control dust emissions from the work area;
where practicable, conduct abrasive blasting operations in an abrasive blasting chamber;
ensure that the screening material for outdoor blasting is tear-resistant, ultraviolet resistant, fire retardant and of suitable material and construction to prevent the escape of fine dust;
avoid using abrasives that contain highly toxic substances; use recyclable and environmentally safe abrasives; and
where practicable, arrange for testing of paint on all painted vessel structures to be blasted where the vessel’s paint history is unknown.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Manual anti-fouling paints

mix paints in drip trays under cover and in a sealed, bunded and well- ventilated paint area;
not mix or prepare anti-fouling paints in coastal or marine waters; clean up spilled paint;
not wash spilled paint into the wastewater collection system; use an absorbent material to wipe or squeeze excess paint; and
not rinse paint containers, rollers or brushes into storm-water drains, gutters or sewers.

Spray painting

ensure that spray painting activities do not create an environmental nuisance;
conduct spray painting on a sealed and bunded surface in a screened area;
not spray paint in windy conditions;
keep spray guns and lines clean and well maintained to reduce emissions;
use efficient spray equipment including high volume low pressure spray guns for outdoor spray painting;
use corrosion inhibitors that are compatible with surface coating requirements, biodegradable and free from chromates, nitrates and nitrites;
use a wash station for cleaning spray equipment and scrape the paint cup free of any residual paint with a spatula before cleaning the equipment with solvent;
ensure that the spray equipment is properly maintained and periodically cleaned;
use a gun wash station or similar for the cleaning of spraying equipment; and
not wash spraying equipment in or near coastal or marine waters.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Welding and metal fabrication

establish an isolated, well-ventilated area for using torches and welders, away from combustible materials such as oils, grease and rubber;
conduct all metal cutting operations on a sealed surface inside a screened area to minimize the horizontal dispersion of metal fragments and allow the sweeping or vacuuming of metal scraps and filings; and
where practicable, reduce the amount of grinding and sanding;
securely wrap all dust and other grinding wastes prior to disposal in an industrial bin; and
dispose of dust and other grinding wastes in an environmentally safe manner.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Engine maintenance and repair

A person shall
regularly maintain vessel engines regularly to prevent oil and fuel leaks to the bilge;
use a drip tray or groundsheet under the engine to collect oil, grease, solvents or detergents;
keep adequate supplies of rags and other absorbent materials for cleaning up small fuel and oil spills;
clean engine parts in a properly designated wash bath or over catch pans located in a covered, sealed and bunded area that is graded to a collection pit or sump;

where practicable, clean engine parts with a brush rather than with solvents or aqueous degreasers such as alkaline or caustic soda;

drain oil filters before disposal;
not place a container or vessel containing residual oil, fuel or other fluids in industrial waste bins unless the container or vessel has been drained and wiped clean; and

Removal of biofouling

inspect hulls and niche areas including sea chests, internal sea water systems, bow thrusters, anchor chests, bilge keels, dry-docking support strips, rope guards, propellers and rudders;
remove and collect all biofouling on the vessel and moorings;
carefully remove biofouling to prevent contamination with paint chips and other hull coatings;
not return collected biofouling to the sea or any waterway;
install waste treatment systems with technology such as filtration technology, neutralization or other chemical treatment processes to minimize the risk of the introduction or translocation marine pests;
(f) report any suspected or discovered marine pest during removal of biofouling from a vessel or mooring to the Environmental Protection Department and Coastal Zone Management Unit;
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Waste management options

- facilitate the disposal of the waste;
- establish a recycling station in a convenient location with clearly labelled waste containers for individual types of solid waste including under cover spill trays for battery storage;
- collect and recycle general waste;

establish a storage area with separate bins or containers for other non- recyclable solid wastes;

reorganize or remove large items from waste containers to prevent blockage;
ensure that there are no obstacles that prevent access to the containers;
ensure that all bins, industrial skips and sealed containers are regularly emptied;
ensure that all containers for waste oils, solvents and other chemicals or potential contaminants including paint, paint thinners or acids are empty and have been dried out before disposal in waste bins;
store controlled or hazardous solid waste on-site in sealed, clearly labelled containers for collection and transportation to an approved waste facility;
ensure that the waste storage area is secure, sealed and bunded; and
erect signs relating to the facility’s waste management and disposal requirements.
- For the purpose of this regulation,
“controlled or hazardous waste” means any waste that is toxic, corrosive, poisonous, combustible, flammable, explosive or capable of leaching;
“general waste” means uncontaminated debris or litter and includes the following:
- cardboard and paper;
- food;
- garden waste generated from vegetation;
- plastics;
- aluminium cans;
- bottles;
- steel cans and drums; or
- any similar waste.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Wastewater collection and treatment system
17.(1)
A person shall design and establish a wastewater collection and
treatment system suitable to its operation.
- A wastewater collection and treatment system shall remove suspended
solids, dissolved and undissolved contaminants, turbidity and discoloration for reuse on-site or discharge to the sewer system.
- A wastewater collection and treatment system shall contain the following:
- a sealed, bunded work area;
- catchment drains and trenches;
- a common sump for the catchment drains;
- tanks with adequate capacity to store and treat the runoff water;
- a sand filter to remove fine particles from the water;
- an oil or water separator;
- flocculation or aeration technology to separate solids; and
- lime stabilization system to precipitate heavy metals.

ensure that the wastewater collection system is separate from the storm- water collection system for other relatively clean areas of the site such as carparks and roofs;
regularly clean and maintain work areas;
ensure that no particles or wastewater from cleaning or maintenance work falls or drains into storm-water;
where practicable, cover work areas to minimize the amount of contaminated runoff;
not wash vessels, hardstand areas, vehicles or machinery parts into the soil, storm-water system or inland or coastal waters;
cover catchment drains and trenches with removable gratings; regularly inspect the gratings;
remove accumulated debris from the gratings;
prevent oily wastes from being mixed with other run-off water that enters the collection system;
construct the waste collection sump so that the accumulated sludge can be removed and transported to an approved waste facility;
fit the sump with removable catchment baskets or cover the sump outlets with a removable screen;
regularly inspect and clean the sump, catchment baskets or removable screens before and after site and vessel cleaning activities;
use above ground polyethylene tanks or below ground concrete tanks for subsequent waste treatment;
- install and ensure that the capacity of a holding tank is adequate to contain wastewater runoff;
- regularly monitor liquid levels in holding tanks in order to avoid any overflow and to detect leaks;
- construct a sand filter in order to remove or replace the surface layers of sand or contaminants;
- clean and maintain oil or water separator in accordance with the manufacturer’s specifications;
- where necessary, install a granular activated carbon filter to remove any dissolved tributyltin; and
- where practicable, reuse the treated water on-site.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Management of liquid waste

establish a secure recycling station for used engine oil, lubricating oil, hydraulic oil, gearbox oil, volatile solvents, thinners and other hydrocarbons;
establish a separate area for liquid waste that cannot be readily recycled including bilge water, liquid paint residues, thinners and solvents and other contaminated water that cannot be treated in the wastewater system;
display signs to show where the recycling station and storage area for non-recyclable liquids are located;
store non-recyclable liquid wastes in separate, sealed containers for disposal at an approved waste disposal facility;

ensure there are enough drums or other containers for collecting and storing recyclable and non-recyclable liquids;
ensure that incompatible wastes are stored separately and in suitable containers;

manage as controlled waste spent abrasive blasting media, sludge or other solids collected by on-site liquid waste management systems including pits, trenches, sumps or holding tanks; and
properly store and dispose of liquid waste.

on summary conviction to a fine of $20 000.
Air quality management

where practicable, not burn coatings from hulls; where practicable, not produce toxic gases;
wrap oily rags, oil-soaked sawdust, plastics, rubber or any other similar material for disposal in an industrial bin;

where practicable, fit power tools with dust extraction and collection systems;

use wet or dry vacuum cleaners with dust filters for general cleaning of the work area floor surface rather than sweeping and hosing the surface down with water;
maintain air pollution control equipment;
immediately repair or replace any emission control equipment that is blocked, frayed, leaking or not functioning within the manufacturer’s specifications;
control any exhaust emissions to prevent nuisance or odours or fumes; and
use mechanical ventilation systems and activated carbon filters or scrubbers to prevent the release of any uncontrolled odours from the facility.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Noise management

A person shall
incorporate acoustic barriers, damping and insulating materials in the facility’s design and layout; and
fit mechanical ventilation systems including air conditioners and fans with noise-proof ducting and acoustically designed intake and exhaust openings.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
In-water vessel maintenance
21.(1)
A person shall not conduct in-water vessel maintenance unless all
waste has been properly secured and contained for transport and disposal at an approved waste facility.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.

SHIPPING (DOMESTIC VESSELS) (MOORING) REGULATIONS, 2024
The Minister, in exercise of the powers conferred on him by section 305(1)
(s) of the Shipping (Domestic Vessels) Act, 2024, makes the following Regulations:
Citation
1.
These Regulations may be cited as the Shipping (Domestic Vessels)
(Mooring) Regulations, 2024.
Definitions
- In these Regulations,
“berth” means a designated place in a port or mooring facility used for mooring vessels;
“Chief Executive Officer” means the person who is responsible for supervising and managing port and harbour areas that are under the authority and management of the Barbados Port Inc.;
“dinghy dock” means the designated area for docking dinghies for the purpose of loading and unloading passengers or supplies;
“marina” means a berthing area with docking facilities under common ownership or control and with berths for 10 or more vessels, including commercial marinas, boating facilities and yacht clubs which may be an independent facility or may be associated with a boatyard;
“moor” means the securing or making fast of a boat, raft or float by means of cables, anchors, lines, chains or other device to the ocean bottom, the shore, a dock, slip, pier, or marina;
“mooring” means a temporary, semi-permanent or permanent anchorage installation comprising an anchor, chain, pennant, mooring buoy or similar device;
“mooring buoy” means a white buoy with a blue band marking a mooring or any other device approved by the Harbour Master;
“mooring location” means the location of a mooring assigned by the Harbour Master to a mooring permit owner;
“mooring permit”
- means the permit issued by the Harbour Master authorizing a mooring permit owner to moor the vessel specified, using the mooring location specified in the permit, in Barbados waters; and
- includes a transient mooring permit and a yearly mooring permit;
“mooring permit owner” means a person to whom a mooring permit has been issued;
“transient mooring permit” means the mooring permit issued by the Harbour Master authorizing a mooring permit owner to moor the vessel specified, using the mooring location specified in the permit, on a temporary basis for a period of not more than 14 days;
“yearly mooring permit” means the mooring permit issued by the Harbour Master authorizing a mooring permit owner to moor the vessel specified, using the mooring location specified in the permit, for a period of more than 14 days but not more than one year.
Duties of the Harbour Master

The Harbour Master shall be responsible for the following: managing mooring activities;
issuing permits under these Regulations; assigning mooring locations;
establishing and maintaining mooring plans;
renting or leasing a mooring, mooring location or mooring equipment; directing the relocation or removal of a mooring;
developing and issuing mooring inspection guidelines; managing mooring inspections;
collecting permit fees under these Regulations; implementing any policy in relation to mooring; and
performing any function necessary to give effect to the Act and its statutory instruments.
- A mooring plan referred to in paragraph (1)(d) shall specify the following:
- the number of vessels that may be moored;
- the vessel sizes;
- the mooring locations; and
- any other information that the Harbour Master may specify.
- Where the Harbour Master suspends, revokes or refuses to issue or renew
a permit, as the case may be, the Harbour Master shall notify, in writing, the permit holder of its decision and the reason for the decision.
- The Harbour Master shall not revoke a permit unless the permit holder has
been given a reasonable opportunity to make representation to the Harbour Master in respect of the revocation.
- The Harbour Master may authorize, in writing, an external person to
perform a specified function or task.
Mooring permit
4.(1)
No person shall moor, anchor or set any mooring or vessel without a
mooring permit.
- Notwithstanding paragraph (1), a person may be exempted from obtaining
a mooring permit in the case of an emergency.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Application
5.(1)
A person may apply to the Harbour Master for a mooring permit in
the specified form and manner.
- An application under paragraph (1) shall be accompanied by the following:
- the specified fee;
- a copy of the vessel’s certificate of registration;
- a description of the mooring equipment to be used to moor the vessel;
- the applicant’s mooring location preference; and
- any other documents and information that the Harbour Master may specify.
Contents of mooring permit
6.
(a)
A mooring permit shall contain the following information: the mooring permit number;
- the name of the vessel owner;
- the vessel to be moored;
- the assigned mooring location; and
- any condition that the Harbour Master may specify.
Issuance of mooring permit
7. Where a person has complied with the requirements of these
Regulations and has paid the specified fee, the Harbour Master shall issue a mooring permit.
Terms, conditions and restrictions
8.(1)
A mooring permit may contain such terms, conditions and restrictions
as are considered necessary.
- Unless suspended or revoked, a mooring permit is valid until the date of
expiry specified therein.
- A permit is not transferable.
Renewal of mooring permit
9.(1)
(2)
A mooring permit may be renewed.
A person may apply to the Harbour Master to renew a mooring permit in
the specified form and manner.
- An application under paragraph (2) shall be accompanied by
- the specified fee; and
- any other document specified by the Harbour Master.
- A person who fails to renew a mooring permit is liable to have an assigned
mooring location forfeited.
Assignment, rent or lease of mooring locations
10.(1)
No person other than the Harbour Master shall assign, rent or lease a
mooring location.
- In determining the assignment of a mooring location, the Harbour Master
shall take into account any information relevant to the vessel including
- the vessel length;
- the vessel size;
- the vessel type; and
- any other relevant factor.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Temporary mooring
11.(1)
No person shall cause a vessel, other than the vessel described in the
mooring permit, to be temporarily moored at an assigned mooring location without the prior written approval of the Harbour Master.
- A mooring permit owner may apply to the Harbour Master for written
approval.
- In determining whether to grant the approval, the Harbour Master shall
take into account the following:
- the vessel length;
- the vessel size;
- the vessel type; and
- any other relevant factor.
Relocation and removal of moorings
12.(1)
No person shall remove or relocate a mooring without the prior written
approval of the Harbour Master.
- Where a mooring is moved from its approved location by adverse weather
or any other cause, the mooring permit owner shall relocate the mooring immediately, or not later than 14 days, from the date that the dislocation of the mooring is discovered.
- The Harbour Master may relocate, remove or cause to be relocated or
removed any mooring or vessel whenever, in the Harbour Master’s judgment, the safety of other vessels or the maximum use of the area requires such action.
- Where a vessel or mooring is to be relocated or removed, the Harbour
Master shall notify the mooring permit owner,
- A mooring permit owner who has been given notice and fails to comply
with a directive given under paragraph (3) shall be liable for any loss incurred.
- A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Dinghy docks

The Harbour Master may
specify how a person is to tie a vessel to a dinghy dock; or direct a person to relocate a vessel from a dinghy dock.
- A person shall comply with a directive given under paragraph (1).
- A person who contravenes paragraph (2) is guilty of an offence and is liable
on summary conviction to a fine of $20 000.
Mooring equipment

A mooring permit owner shall
maintain in good condition mooring equipment; and replace mooring equipment that is not in good condition.
- A mooring permit owner shall ensure that chains, eye bolts, swivels,
shackles and thimbles conform to ASTM A413 Test Standard or equivalent ISO Standards.
- A person who contravenes paragraph (1) or (2) is guilty of an offence and
is liable on summary conviction to a fine of $20 000.
- For the purposes of this regulation, “ASTM A413” means the Standard
Specification for Standard Steel Chains developed by the American Society for Testing and Materials.
Duties of approved marine surveyors

An approved marine surveyor shall install, service and inspect a mooring;
certify that mooring equipment, including mooring tackles, comply with these Regulations;
prepare and submit mooring inspection reports to the Harbour Master;
comply with any mooring inspection guidelines issued by the Harbour Master;
comply with any directive issued by the Administration; and comply with the provisions of the Act and these Regulations.
Mooring inspection

No person shall place a mooring in service without a mooring inspection; and
certification from an approved marine surveyor that the mooring is fit for its intended service.
- A mooring permit owner shall ensure the inspection of a mooring.
- An approved marine surveyor shall
- conduct a mooring inspection; and
- prepare and submit a report of the mooring inspection, within 30 days of the mooring inspection, to the Harbour Master.
- The Harbour Master may
- inspect or cause a mooring to be inspected;
- require a mooring permit owner to have his mooring hoisted, at the expense of the mooring permit owner, for the purpose of conducting a visual examination to determine the condition of the mooring; and
- remove or cause a mooring to be removed that fails to meet the requirements of these Regulations.
- Where a mooring is found defective, the mooring permit owner shall rectify

the defective condition before the mooring is put into operation.
- A mooring may be inspected by hoisting the mooring out of the water,
underwater visual inspection or by any other method of inspection.
- A person who contravenes paragraph (1), (2) or (5) is guilty of an offence
and is liable on summary conviction to a fine of $20 000.
Fraudulent mooring inspection report

No approved marine surveyor shall prepare a mooring inspection
that contains false information;
without conducting a mooring inspection; or
that falsely states a mooring is fit for the intended service.
(2) A person who contravenes paragraph (1) is guilty of an offence and is liable
on summary conviction to a fine of $20 000 or imprisonment for 2 years or to both and is liable to have his name removed from the register of approved marine surveyors.
Suspension, revocation, refusal to renew mooring permit
- Where a mooring permit owner fails to comply with any provision of
these Regulations or with any condition stated in a mooring permit, the Harbour Master may suspend, revoke or refuse to renew the mooring permit.

SHIPPING (DOMESTIC VESSELS) (FORMS) REGULATIONS, 2024
The Minister, in exercise of the powers conferred on him by section 305(1)
(w) of the Shipping (Domestic Vessels) Act, 2024, makes the following Regulations:
- These Regulations may be cited as the Shipping (Domestic Vessels)
(Forms) Regulations, 2024.
- The forms set out in the Schedule shall be used for the purposes to
which they relate.

SHIPPING (DOMESTIC VESSELS) (WATER SPORTS) ORDER, 2024
The Minister, in exercise of the powers conferred on him by section 10(b) and section 11(b) of the Shipping (Domestic Vessels) Act, 2024, makes the following Order:
- This Order may be cited as the Shipping (Domestic Vessels) (Water
Sports) Order, 2024.
- The areas specified in the Schedule are the areas in which the following
water sports activities may be undertaken:

in the case of power boats engaged in waterskiing, the area lying between 75 metres and 200 metres from the shore, parallel to the shore;
in the case of any other water sports activity, the area beyond 200 metres from the shore, parallel to the shore; and
in the case of water sports activity in Carlisle Bay, the area beyond 450 metres from the shore, parallel to the shore.
The areas referred to in paragraph 2 shall be clearly marked by buoys.
