EXCERPTS FROM LABOUR CLAUSES (CONCESSIONS) ACT, 2024 ESTABLISHMENT OF MINIMUM RATES OF PAY AND CONDITIONS OF WORK IN THE ACCOMMODATION SECTOR
Labour Clauses (Concessions) Act, 2024
Establishment of Minimum Rates of Pay and Conditions of Work in the Accommodation Sector
- Conditions of Work
(a) Hours of Work
- The normal hours of work shall be as outlined by the employee’s contract of employment but shall not exceed 40 hours per week over a period of 5 days. Work on any one day shall not exceed eight (8) hours exclusive of mealtime. Mealtime shall not be less than half an hour where meals are provided by the employer. If meals are not provided the employee shall be entitled to a mealtime of not less than one hour. These conditions do not apply in the instance where employees work on a half day basis.
- The daily hours of work of employees shall be set out in a written schedule, issued by the employer to meet the requirements of his / her business.
- Other than in exceptional circumstances, the written schedule of the daily hours of work shall be posted and accessible by all employees no later than 48 hours before the beginning of the work-week.
- Night Differential
A night differential of 1:50 shall be paid to an employee for every hour of his / her rostered or requested shift that falls between 11:00 p.m. and 7:00 a.m. The period 11:00 p.m. to 7:00 a.m. are deemed to be unsociable hours.
- Meal allowance – quantum
Where a meal is not provided by the workplace, a meal allowance of not less than
$8.00 shall be provided to the employee for each day that he / she works as the commuted value of the meal that should ordinarily have been supplied by the employer. The allowance is payable in addition to all other sums due.
(d) Overtime Payments
- Pay for work performed beyond an employee’s normal hours of work on an ordinary working day shall be calculated at the rate of one and one half times the employee’s normal rate of pay.
- Pay for work performed on a Public Holiday shall be calculated at the rate of two times the employee’s normal rate of pay.
- An employee who works on his / her day-off (or rest day) shall be paid at double his / her normal rate of pay.
(e) Split Shifts
- Where split shifts are in operation, there shall not be more than three (3) in a five
(5) day work cycle.
- An employee who is required to work a split shift shall be permitted to remain on the property at the workplace within staff areas during the hours between shifts.

(f) Staff Facilities
The employer is required to provide facilities for use by staff including:
- suitable and adequate sanitary conveniences
- suitable and adequate rest room and sick bay facilities
- first aid
- suitable and adequate facilities for the taking of meals
- suitable and adequate facilities for the changing and storing of clothing where the change of clothing is necessary at the workplace
- The Safety and Health at Work Act, Cap. 356 and the Regulations to the Act, apply to the sector. At present, the Regulations include guidance on the following matters: noise; drinking water; general duties; personal protective equipment; sanitary conveniences; workstations; washing facilities; and fuel stations – medical supervision.
The Regulations are presented at Appendix 3.
(h) Consultation on Occupational Safety and Health
At the workplace, employers and employees must consult on matters concerning occupational safety and health through a joint Safety and Health Committee or a safety delegate(s), in accordance with the provisions of the Safety and Health at Work Act, Cap. 356.
- In each workplace where there are more than 25 employees, a joint Health and Safety Committee is to be established. The Committee must be comprised of an equal number of representatives appointed by the employer and representatives appointed by the employees.
(ii) Where less than 25 persons are employed and it is not practical to have a Health and Safety Committee, one or more safety delegates must be appointed by the employees.
(i) Safety footwear
- Safety footwear, appropriate for the task, shall be provided by the employer to employees who are engaged as maintenance staff, stewards, kitchen staff, housemen, gardeners and porters.
- The employer shall conduct risk assessments to determine any other areas where safety footwear is required
- Arrangements are to be put in place to replace the footwear as needed due to normal wear and tear.
- Safety footwear is to be provided at no cost to the employee.
The employee has the responsibility to take appropriate care of footwear provided by the employer.
(j) Uniforms
Where an employer requires that a distinctive uniform is to be worn by an employee, at least three (3) changes of uniforms shall be provided to the employee on an annual basis by the employer, at no cost to the employee.
The employee has the responsibility to take appropriate care of uniforms provided by the employer.

(k) Transportation
- Where an employee is required to work beyond 12:00 midnight, the employer shall provide for the employee, transportation to his or her home.
- Where on a workday an employee is required to report to for duty before or up to 6:00 a.m, the employer shall provide transportation to work for that day at no cost to the employee.
- Where an employee is not expected to work beyond 12:00 midnight but expects to take the 12:00 midnight or last scheduled public transport vehicle to his/her home, the employees should advise the employer of his / her transportation issues so that adequate provision can be made for them to be permitted to take the public night transportation. An employee who is granted permission in this instance shall not suffer any loss of wages.
- If due to the demands of the business, the employee cannot be released to take the last scheduled public transport vehicle to his / her home, the employer shall provide transportation for that employee to his / her home without any cost to the employee.
