PRACTICE DIRECTION NO 1 OF 2023
THE MAXIMUM NET WORTH QUALIFICATION FOR WAIVER OF FEES/SECURITY
FOR COSTS FOR SAINT LUCIA
AND
THE MAXIMUM AMOUNT OF SECURITY FOR COSTS FOR SAINT LUCIA
1.0 AUTHORITY
This Practice Direction is issued by the President of the Caribbean Court of Justice pursuant to Part 18.1 of the Caribbean Court of Justice (Appellate Jurisdiction) Rules 2021 (“the Rules”).
2.0 COMMENCEMENT AND DURATION
This Practice Direction shall take effect from the date on which it is issued and shall remain in effect until the Caribbean Court of Justice (Appellate Jurisdiction) Rules 2023 enter into force.
3.0 DIRECTION
(i)
WHEREAS pursuant to Rule 10.7 of the Rules, the Court of Appeal of the Eastern Caribbean Supreme Court (“the court below”) shall require an applicant to provide security for costs when making an order granting leave to appeal in noncriminal appeals.
(ii)
WHEREAS the Rules do not currently provide for the maximum amount of security for costs that an applicant in Saint Lucia may be ordered to provide.
(iii) WHEREAS pursuant to Rule 10.18 of the Rules an applicant who wishes to obtain a waiver of fees/security for costs shall, file an application for such waiver.
(iv)
WHEREAS the Rules do not currently provide for the maximum net worth qualification for waiver of fees/security for costs for applicants in Saint Lucia who are desirous of making an application for such waiver.
(v)
WHEREAS it has therefore become necessary to issue this Practice Direction to indicate the maximum net worth qualification for waiver of fees/security for costs and the maximum amount of security for costs in Saint Lucia.

Accordingly, the following measures shall take effect:
a) The maximum net worth qualification for waiver of fees/security for costs for Saint Lucia is EC$10,000.00.
b) The maximum amount of security for costs that may be ordered by the court below is EC$7,500.00.

Summary Consolidated Financial Statements
The summary consolidated financial statements do not contain all the disclosures required by International Financial Reporting Standards. Reading the summary consolidated financial statements and the auditor’s report thereon, therefore, is not a substitute for reading the audited consolidated financial statements and the auditor’s report thereon.

We expressed an unmodified audit opinion on the audited consolidated financial statements in our report dated September 19, 2023.
Management’s Responsibility for the Summary Consolidated Financial Statements
Management is responsible for the preparation of the summary consolidated financial statements in accordance with the provisions of the Insurance Act.
Auditors’ Responsibility
Our responsibility is to express an opinion on whether the summary consolidated financial statements are consistent, in all material respects, with the audited consolidated financial statements based on our procedures, which were conducted in accordance with International Standard on Auditing (ISA) 810 (Revised), Engagements to Report on Summary Financial Statements.
