OBJECTS AND REASONS
This Bill would validate learner’s permits and driving licences issued to applicants under the age of 25 years by the Licensing Authority on 11th December, 2017 to 30th September, 2022 in respect of heavy goods vehicles, motor omnibuses, motor tractors and public service vehicles and the fees charged and collected by the Barbados Revenue Authority on those dates for the issue of such learner’s permits and driving licences.

An Act to validate the learner’s permits and driving licences issued and the fees charged and collected for the issue of such learner’s permits and driving licences on 11th December, 2017 to 30th September, 2022 for certain categories of vehicles.
ENACTED by the Parliament of Barbados as follows:
Short title

  1. This Act may be cited as the Road Traffic (Learner’s Permits and Driving Licences)(Validation)Act, 2022.
    Validation of learner’s permits and driving licences
  2. All learner’s permits and driving licences issued by the Licensing Authority on the 11th day of December, 2017 to 30th day of September, 2022, to an applicant under the age of 25 years, to drive a heavy goods vehicle, motor omnibus, motor tractor or public service vehicle, shall be deemed to have been lawfully and validly issued as if the age of the applicant referred to in section 69 of the Road Traffic Act, Cap. 295 was 18 years.
    Validation of fees
  3. All fees charged and collected on the 11th day of December, 2017 to the 30th day of September, 2022 in respect of an applicant under the age of 25 years for
    (a)
    the grant of a learner’s permit; or

(b)
the issue of a driving licence,

to drive a heavy goods vehicle, motor omnibus, motor tractor or public service vehicle, shall be deemed to have been lawfully and validly charged and collected as if the age of the applicant referred to in section 69 of the Road Traffic Act, Cap. 295 was 18 years.

OBJECTS AND REASONS
This Bill would amend the Road Traffic Act, Cap. 295 to provide
(a)
for the age of 18 years to be the minimum age at which a driving licence is to be issued to drive a contract carriage, heavy goods vehicle, hired car, motor tractor or self-driven car;

(b)
for the age of 25 years to be the minimum age at which a driving licence is to be issued to drive a motor omnibus or public service vehicle; and

(c)
for related matters.

An Act to amend the Road Traffic Act, Cap. 295. ENACTED by the Parliament of Barbados as follows:
Short title

  1. This Act may be cited as the Road Traffic (Amendment)(No. ) Act, 2022.
    Amendment of section 2 of Cap. 295
  2. Section 2 of the Road Traffic Act, Cap. 295 in this Act referred to as the principal Act is amended
    (a) by inserting the following definitions in the appropriate alphabetical order:
    “ “contract carriage” means a motor vehicle kept for hire or reward under a contract where
    (a)
    that motor vehicle is used for the conveyance of not more than 6 persons;

(b)
payment for the use of that motor vehicle is at or for a fixed rate or amount; and

(c)
that motor vehicle does not stand or ply for hire on any road or place in public view or to which the public have access;

“hired car” means a motor vehicle kept for hire or reward under a contract where
(a)
that motor vehicle is used for the conveyance of not more than 6 persons;

(b)
payment for the use of that motor vehicle is at or for a fixed rate or amount; and

(c)
that motor vehicle does not stand or ply for hire on any road or place in public view or to which the public have access;

“self-driven car” means a motor vehicle kept for hire or reward under a contract where
(a) that motor vehicle is used for the conveyance of not more than 6 persons;
(b)
payment for the use of that motor vehicle is at or for a fixed

rate or amount; and

(c)
that motor vehicle does not stand or ply for hire on any road or place in public view or to which the public have access;”; and

(b) by deleting the definition “contract carriage”, “hired car”, “selfdriven car”.
Amendment of section 69 of Cap. 295

  1. Section 69 of the principal Act is amended by deleting subsection (1) and substituting the following:
    “Restrictions on issue of driving licence for certain vehicles
    69.(1) Subject to section 62, a driving licence shall not be issued or endorsed as valid to an applicant who
    (a)
    is under the age of 18 years for the purpose of driving

(i)
a contract carriage;

(ii)
a heavy goods vehicle;

(iii) a hired car;
(iv)
a motor tractor; or

(v)
a self-driven car; or

(b)
is under the age of 25 years for the purpose of driving

(i)
a motor omnibus; or

(ii)
a public service vehicle. ”.

TOURISM DEVELOPMENT (OCEAN GROVE HOTEL AND DEVELOPMENT) NOTICE, 2022
The Minister, in exercise of the powers conferred on him by section 5 of the Tourism Development Act, gives the following Notice:

  1. This Notice may be cited as the Tourism Development (Ocean Grove Hotel and Development) Notice, 2022.
  2. Interim approval has been granted, with the approval of the Cabinet, to the applicant, Lancaster Park Central Limited, in respect of a tourism project for the construction of a hotel to be known as “Ocean Grove Hotel and Development”, situated at Ocean Grove “Taymoor”, Gibbs in the parish of Saint Peter.
